- Department of MemorandumVeterans Affairs Date: August 19, 2009 From:Anna Weishaar, VISN 15 Contracting Office Subj:Justification and Approval for Veteran-Owned Small Business Sole-Source Set-Aside IAW P.L. 109-461 and VA Information Letter 049-07-08 To: Contract File 1. IDENTIFICATION AND DESCRIPTION OF ACTION BEING APPROVED: This action is based on a requirement for Standard Hospital Bed Units for the St. Louis VAMC, being procured in accordance with the Federal Acquisition Regulation (FAR). It is being sole-sourced for a Veteran Owned Small Business (in accordance with P.L. 109-461, Sec. 8127, paragraph d., 38 U.S.C. 8127 and VA Information Letter 049-07-08), Alliant Enterprises, LLC, DBA Alliant Healthcare Products. 2.DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED: The contract is for the purchase of 10 Standard Hospital Bed Units. The total contract value is $314,999.44 3.IDENTIFICATION OF STATUTORY AUTHORITY: The requirement will be procured under P.L. 109-461, Sec. 8127. 4. DEMONSTRATION THAT THE ACQUISITION REQUIRES USE OF AUTHORITY CITED: Pursuant to 38 U.S.C. 8127(c), contracting officers may use other than competitive procedures (including sole-source awards) for contracts to Service-Disabled Veteran-Owned Small Businesses (SDVOSB) and Veteran-Owned Small Businesses (VOSB) where the anticipated price will exceed the Simplified Acquisition Procedures threshold, but not to exceed $5,000,000 (including options). 5. DEMONSTRATION THAT THE ANTICIPATED COST WILL BE FAIR AND REASONABLE: The procurement was reviewed against other contractors' products to determine price fair and reasonableness. Other comparable beds were found and prices were determined to be comparable with the product being purchased. 6. CONTRACTING OFFICER'S CERTIFICATION: "I certify that the facts and representations under my cognizance which are included in this Justification and Approval are accurate and complete to the best of my knowledge and belief." /es/Anna WeishaarContracting Officer
