The United States Government, represented by the Department of State, is seeking proposals (OF 612’s) from U.S. citizens interested in providing the PSC services described in the attached. Submissions shall be in accordance with the attached information at the place and time specified. Any questions may be directed to Yvette P. CLOSING DATE/TIME SPECIFIED: 09/13/2009 FOR RECEIPT OF APPLICATIONS: 16:00 PM ET 4. POSITION TITLE: PSC-Guinea-Bissau Prosecutor Advisor 5. MARKET VALUE: FS-02: 6. PERIOD OF PERFORMANCE: One year from the date of award 7. PLACE OF PERFORMANCE: Guinea-Bissau 8. JOB DESCRIPTION: See below PSC--Guinea-Bissau Prosecutor Advisor GENERAL STATEMENT OF THE PURPOSE OF THIS CONTRACT AND RESPONSIBILITIES OF THE CONTRACTOR The Bureau of International Narcotics and Law Enforcement Affairs (INL) of the Department of State urgently seeks an experienced prosecutor for an immediate one-year assignment to Embassy Dakar, from which he/she will be detailed to Guinea-Bissau. The basic duties of the prosecutor will be to advise and mentor local prosecutors in Guinea-Bissau to improve their capacity to gather evidence and bring cogent, well-argued cases to court. The mission of the prosecutor will be to improve the performance of the Guinea-Bissau prosecutors and investigators he/she advises and mentors by sharing lessons learned, experiences, and offering on-the-job training. The advisor must also analyze and report on crime problems in Guinea-Bissau, and the response to those problems by the authorities in Guinea-Bissau. Success will be measured by the growth in capacity of Guinea-Bissau staff advised and mentored, as measured by such factors as successful investigations and effectively conducted prosecutions. STATEMENT OF DUTIES Developing a work plan for the year ahead, within 60 days after arriving in Bissau. Support local prosecutors in planning and coordinating their work with a view to strengthening the service’s capacity to respond to drug-related crime; Identifying and addressing institutional and operational shortfalls hampering effective prosecution; Ensuring high quality prosecution of drug-related crimes through advising on organization, equipment and training needs; Developing and implementing strategies that aim at improving human resources management, staffing and recruitment policies, performance review and disciplinary procedures; Intensifying prosecutor cooperation with the judicial police and other police bodies, including through assisting in the organization of joint meetings and workshops in relation to drug related crime; Increasing the local prosecutor service’s capacity for criminal asset seizure; Establishing professional working relationships with national (Guinea-Bissau) as well as international stakeholders. Establishing a monitoring and evaluation plan, in collaboration with Department of State, INL and Embassy Dakar, within 45 days of arrival in Guinea-Bissau. POSITION ELEMENTS Initially the Prosecutor Advisor PSC will live and work in Bissau as an independent U.S. prosecutor-advisor to the prosecutorial service of Guinea-Bissau, while being formally attached to the U.S. Embassy in Dakar Senegal. Seconding to the EU Security Sector Reform (SSR) Mission Guinea-Bissau: At some point, after the initial period, the PSC Prosecutor Advisor may be seconded to the European Union’s Security Sector Reform Mission in Guinea-Bissau. This will mean joining the EU Mission as a full-fledged member of the staff and working with the Prosecutorial Team of the EU Mission which consists of one European prosecutor in Guinea-Bissau. The Mission also includes advisors in other disciplines including police and military officers. The Prosecutorial Team of the European Union’s Mission will focus on helping Guinea-Bissau investigators and prosecutors respond to crime by improving their capacity to bring well-prepared cases to trial in similar fashion to the objectives of the independent U.S. prosecutor-advisor. Fitting into the EU Mission’s structure and accommodating himself/herself to the Mission’s priorities and objectives will be an important goal for the U.S. prosecutor-advisor. This might involve some changes from the prosecutor-advisor’s activities and goals as an independent U.S. advisor. Identifying the differences and accommodating himself/herself to them will be an important factor in the continuing success of the U.S. prosecutor advisor’s mission. Supervision Received Initially, the U.S. prosecutor-advisor shall work under the guidance of INL and under Chief of Mission Authority from the U.S. Ambassador in Dakar. Later, the prosecutor-advisor may be a member of the EU Mission and he/she will report to designated superiors within the EU Mission staff, and plan/coordinate his/her activities in accordance with the EU SSR Mission’s priorities and objectives. Place of Performance Most work will be performed in Guinea-Bissau. Initially, the prosecutor will spend a brief period of time in Dakar, Senegal at the U.S. Embassy checking in and getting to know backstop personnel at the Embassy. MINIMUM QUALIFICATIONS Citizenship: Must be a U.S. citizen who is able to obtain a Department of State secret security clearance. A degree in law (JD, LLB or LLD), preferably an advanced degree, with specialization in criminal or international law. At least ten years of professional experience as a prosecutor, investigating judge or practicing lawyer. Substantial knowledge and experience in management and administration of a prosecution service. Strong analytical, planning and organizational skills and the ability to work independently with minimal supervision. Excellent oral and written English communication skills. Typing and basic computer skills needed to use information technology and management systems required. Computer skills should include word processing and spreadsheet applications. Prior overseas experience in the field of criminal justice is highly desirable, and African experience is also highly desirable. Portuguese language, desirable, but not required. Required Skills/Abilities It is likely that different parts of the justice system in Guinea-Bissau are not working together effectively, and the prosecutorial advisor will work to encourage closer coordination of investigators and Guinea-Bissau prosecutors. To assess what is wrong and to judge what is necessary requires an individual with experience in assembling prosecutions and with analytical capacity. The skills necessary for this position are adaptability to a foreign country with very different circumstances from those in the United States. A prosecutor-advisor will need to develop a quick understanding of the role of advisor, including acceptance of the fact that an advisor rarely succeeds by doing the job him/herself, but rather must find a way to help the person he/she advises to see the issue as he/she sees it and act accordingly. A significant part of the job is reporting and learning quickly about Guinea-Bissau and how crime has affected this small, poor African country, and communicating what he/she has learned to various consumers of this information. Evaluation Criteria Factor 1. Offeror's demonstrated experience in designing and implementing prosecutorial programs. (25 points x _____=______) Factor 2. (25 points x _____=_____) Factor 4. An evaluation of applicant’s ability to perform under the contract based on past performance. In conducting the evaluation, the Government reserves the right to utilize all evaluation information available at the time of evaluation, whether provided by the applicant or obtained from other sources. (25 points x _____=_____) COMPENSATION Compensation for the position will be negotiated as follows: accumulated experience will dictate the salary level within the grade range. Entry level salary normally will be at the first step of the grade range for the position. Consideration will be given, however, to the successful applicant’s experience that is specifically relevant to the position being filled. Number of years of relevant experience will determine the step within the grade range at which the successful applicant will be compensated.
