- Justification For Other Than Full And Open Competition 1. Identification of Agency and Contracting Activity This justification for Other than Full and Open Competition is executed by the U.S. Department of Commerce, National Institute of Standards and Technology (NIST), Acquisition Management Division (AMD), Gaithersburg, MD. 2. Nature/Description of Action On July 15, 2009, NIST/AMD awarded a letter contract on a sole-source basis to Power Resources International, Inc. (PRI), 31 Nancy Street, West Babylon, NY, 11704, to upgrade the Control Room for the NBS Reactor at the NIST Center for Neutron Research (NCNR). 3. Description of Supplies/Services NIST requires the turnkey design, engineering, configuration management, manufacturing, staging, factory testing, demonstration, delivery, installation, wiring field testing, field servicing, and personnel training for an integrated display and control system. The system shall include work stations, printers, system cabinets, console, control equipment, power supplies, input/output modules, processor(s), auxiliary relays and other associated equipment and engineering. The estimated value of the contract is $6,000,000. 4. Identification of Statutory Authority 41 U.S.C. 253(c)(2). 5. Demonstration that the Nature of the Acquisition Requires Use of 41 U.S.C. 253(c)(2) NIST determined its need for the control room upgrade was of such an unusual and compelling urgency that it would be seriously injured unless it limited the number of sources from which it solicited proposals. The NCNR supports important NIST measurement needs and is also operated as a major national user facility with merit-based access made available to the entire U.S. technological community. Each year, more than 2000 research participants from government, industry, and academia use the facility. NIST’s five-year NCNR Expansion Initiative will significantly expand the capacity of the NCNR to help meet urgent national needs for state-of-the-art neutron research capabilities. The Initiative includes many highly inter-related activities that must be closely coordinated for the overall effort to be successful. Certain activities associated with the initiative had to be scheduled to coincide with a 10-month reactor outage period scheduled to commence on May 24,2010. The upgrade of the control room, which NIST estimates requires an 18-month period of performance, must be accomplished during the outage period. Failure to effectively coordinate the control room upgrade with other activities scheduled during the outage period will result in significant disruption and delay and would result in serious programmatic and financial injury to NIST. 6. Synopses of Proposed Action In accordance with FAR 5.202(a)(2), which applies where the agency’s need is of an unusual and compelling urgency, NIST determined that it would be seriously injured if it complied with the time periods specified in FAR 5.203. 7. Determination of Fair and Reasonable Cost The Contracting Officer has determined that the estimated costs to the Government will be fair and reasonable. 8. Description of Market Research NIST and the Department of Energy, Brookhaven National Laboratory, conducted market research to identify potential sources to perform the requirement. The market research was conducted prior to the submission to NIST AMD. 9. Any Other Supporting Facts NIST estimates that an unscheduled extension of the outage period would result in a financial injury of approximately $100,000 per day. The financial injury is based on the NCNR’s daily fixed rate of $100,000.00 per day for each day the reactor is shutdown. 10. Listing of Interested Sources No other sources expressed written interest in this acquisition. 11. Actions Taken to Remove Barriers to Competition NIST does not anticipate a subsequent acquisition for these services. 12. The Contracting Officer hereby certifies the justification is accurate and complete to the best of the contracting officer’s knowledge and belief.
