- The National Cancer Institute (NCI), Center for Cancer Research (CCR), Applied Molecular Pathology Laboratory (AMPL) plans to procure the brand name TMArrayer-9; 0.6mm; 1.0mm; 1.5mm; and 2.0mm punch sets manufactured by Pathology Devices; PO Box1093; Westminster, MD 21157. The supplies are herein are being procured in accordance with the simplified acquisition procedures authorized by FAR Part 13.106-(b) (1). The North American Industry Classification System code is 334516 and the business size standard is 500 employees. This notice is not a request for competitive quotation. However, if any interested party believes it can meet the above requirement, it may submit a statement of capabilities. The statement of capabilities and any other information furnished must be in writing and must contain material in sufficient detail to allow NCI to determine if the party can perform the requirement. No faxed or emailed capability statements will be accepted. Contractor shall provide one (1) original and one (1) copy of the capability statement. Capability statements must be received in the contracting office by 11:00 AM EST, by August 24, 2009. All questions must be in writing and can be faxed or emailed to: Ashley Virts, Contract Specialist via electronic mail at virtsa@mail.nih.gov or fax to 301-402-4513. It is the vendors' responsibility to ensure all questions have been received in the contracting office. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No collect calls will be accepted. In order to receive an award, contractors must be registered and have valid certification in the Central Contractor Registration (CCR) and the Online Representations and Certifications Applications (ORCA). Reference: NCI-90181-AV on all correspondence. Part I: Background information and description of requirements: The Applied Molecular Pathology Laboratory (AMPL) currently produces and analyzes tissue microarrays (TMAs) facilitated by semi-automated tissue arrayers. The AMPL is looking to procure a high capacity semi-automated tissue arrayer to increase TMA production substantially for their purposes. The lab's epidemiology based studies require the equipment to provide total reagent and specimen tracking throughout the assay procedure. Acquisition of a semi-automated tissue arrayer that utilizes a manual two-needle arrayer will facilitate production of replicate tissue for eight of more recipient blocks at one time critical to current studies. Delivery Date: 8 weeks from date of award. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION: Part II: Facts and Reasons to Justify Other than Full and Open Competition: Statutory Authority Statute: This justification has been prepared under the authority of 41 U.S.C. 253 (c)(1) as set forth in 13.106-1 (b)(1) Justification: Pathology Devices is the sole source provider of the TM-Arrayer-9, which is a semi-automated tissue microarrayer. The semi-automated version of the instrument allows for a motorized platen that accommodates more than eight recipient blocks at one time for study and is the only known of its kind on the market. The two-needle based approach under manual control allows for unmatched quality construction of tissue microarrays, while the multiple block tissue arrayer facilitates reproduction of replicate tissue arrays critical for the epidemiology based studies in the lab. Pathology Devices is the only company identified that offers an instrument that meets the specifications below.
