- DEPARTMENT OF VETERANS AFFAIRSVETERANS INTEGRATED SERVICE NETWORK 6JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITIONFAR 6.302-1, 41 U.S.C. 253 (c)(1) 1.CONTRACTING AGENCY: The VISN 6 Centralized Acquisition Service,in support of the Department of Veterans Affairs Medical Center DurhamNorth Carolina, intends to execute a Justification for Other Than Fulland Open Competition for the following procurement. 2.DESCRIPTION OF ACTION: The undersigned proposes to procureSimplex Life Safety and Services equipment for the Durham VA MedicalCenter. 3.DESCRIPTION OF SUPPLIES/SERVICES:. Contractor shall furnishlabor and materials and perform work for the upgrade of the existingfire alarm system. Various related general construction items include,infection control measures, demolition and repair of existing wall andceiling finishes and assorted patching and painting. Contractor shallprovide an extended warranty and off-site alarm monitoring for theperiod of five years upon the completion of the project 4AUTHORITY CITED: Under the authority of Title 41 U.S.C. 254 (1)and FAR 6.302-1(ii))(A) other than full and open competition isjustified when there is a reasonable basis to conclude that the agency'sminimum needs can only be satisfied by unique supplies or servicesavailable from only one source or only one supplier with uniquecapabilities. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLYONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED.The current fire alarm system and peripheral devices are proprietary toSimplex Grinnell. For this project many of the existing peripheraldevices i.e. strobes, alarms, pull stations, etc. can be reused byinstalling a new Simplex Grinnell system. Reusing peripheral deviceswill save the cost of each device, including labor and wiring, andminimize disruptions to several patient care areas thereby minimizingthe impact to the Medical Center. The new Simplex Grinnell system iscompletely compatible with the existing fire alarm system, which willeliminate downtime as each area is being renovated and eliminate theneed to keep two separate operational fire alarm systems throughout therenovation process. The A/E firm hired by the VA has designed theproject to install Simplex Fire Alarm system to minimize downtime,eliminate the need for two parallel fire alarm systems duringconstruction, reduce construction cost, and minimized disruption topatient care and administrative areas. In FY 2008 this project was bidas SDVOSB set aside and the low bid was over signifigantly higher thanthe government estimate. The SDVOSB would also be subbing most of thework to the FSS Schedule holder who we desire to contract with directly.No Award was made because it grossly exceeds the Independent GovernmentEstimate. The A/E confirmed that if they could install as a turn-keyinstallation with the manufacturer the cost would have been about $1million less which is inline with the IGE. Simplex Grinnell is the onlyavailable source which holds a FSS contract # GS-07F-0396M on this item.Other FSS Vendors were contacted in accordance with FAR 8.405-6 (a)1(c)(f)(h). and they responded that the work had to be done by SimplexGrinnell since the equipment is propriety. 4.REASON FOR AUTHORITY CITED: Market research was conducted and ithas been concluded that Simplex Grinnell is the only availabledistributor of this equipment. Simplex Grinell has an FSS contract forthis product under FSS. # GS-07F-0396M. They are the only company thatcan work on the equipment since it is propriety. 5.EFFORTS TO OBTAIN COMPETITION: Since this item is available froma mandatory source, FSS, there was no effort to seek potential sourcesfrom outside that source. 6.FAIR AND REASONABLE PRICE DETERMINATION: This action waspreviously procured as an SDVOSB set aside. The lowest bid came in at$4,095,900. There was no award made since it was not deemed fair andreasonable. Using Simplex's GSA schedule the work is $2.9 million withinthe competitive range of the IGE making the cost the Fair andReasonable. 7.MARKET SURVEY/RESEARCH: Market research efforts are described inparagraph 5 and 6 above. 8.OTHER FACTORS: No other company can interface to our SimplexGrinnell fire alarm system so Full & Open Competition is not asoliciting option. 9.INTERESTED SOURCES: As indicated above, no other FSS source isavailable for procuring this product. Therefore, no other sources werecontacted to provide this product. 10.AGENCY ACTIONS TO INCREASE COMPETITION: Under the authoritiesand actions cited above and the fact there is no other available source,there are no actions to be taken to overcome barriers to competition. 11.CONTRACTING OFFICERS CERTIFICATION: This justification isaccurate and complete to the best of the Contracting Officer's knowledgeand belief.
