Description: Louis Stokes ClevelandDepartment of Veterans Affairs Medical CenterVISN 10 Contracting ManagementJustification and Approval for Other than Full and Open Competition Upon the basis of the following justification, the use of other than full and open competition for the proposed contract action is hereby recommended for approval pursuant to the authority of 41 U.S.C. 253(c) (1), and FAR 6.302-5, Authorized or required by statute. 1.Identification of Agency and Contracting Activity The Louis Stokes Cleveland VA Medical Center, 10000 Brecksville Road, Brecksville, OH 44141, VISN 10 Contracting Activity, 90C(B). 2.Nature/Description of Action This activity proposes to solicit with VETcorp, Inc., using sole source procurement procedures for the delivery of bulk road salt to the Brecksville facility, located at 10000 Brecksville Road, Brecksville, Ohio 44141. This will be for a one year contract IAW FAR 17.202(c), due to the instability of the current market. 3.Description of Supplies/Services The proposed procurement will provide the LSVAMC with bulk road salt deliveries in minimum loads of 25 tons, and within 24 hours of calling in the order. The yearly estimate is 400 tons. 4.Identification of Statutory Authority ( ) 41 U.S.C. 253 (c) (1) Only One Responsible Source( ) 41 U.S.C. 253 (c) (2) Unusual and Compelling Urgency( ) 41 U.S.C. 253 (c) (3) Industrial, Mobilization, Engineering, Developmental, or Research Capability or Expert Services( ) 41 U.S.C. 253 (c) (4) International Agreement(X) 41 U.S.C. 253 (c) (5) Authorized or Required by Statute( ) 41 U.S.C. 253 (c) (6) National Security( ) 41 U.S.C. 253 (c) (7) Public Interest 5.Demonstration of Contractor's Unique Qualifications VETcorp, Inc. is a SDVOSB that can provide the above mentioned services. IAW IL 049-07-08, the contracting officer may use other than competitive procedures for this procurement. 6. Publicized Requirements The J&A will be posted on FBO within 30 days of the award. Synopsis is not required per FAR 5.202(a)(4). 7.Determination of a Fair and Reasonable Cost The contracting officer has determined the price of this service to be fair and reasonable based on last year's price. The previous contract was with Chem-Sales, a VOSB. The cost of last year's service was $151.78/ton. The price for option year one of the contract was $166.96/ton. The option year was not exercised, as a quote was received by VETcorp, Inc. for $88.02/ton. The total value for this one year contract is $35,208.00. 8.Market Survey IAW IL 049-07-08, a sole source award can be made to a SDVOSB if the price is determined to be fair and reasonable. 9.Other Supporting Data None 10.
