- This is a notice of intent to award a sole-source contract pursuant to FAR Part 12 - Acquisition of Commercial Items and is not a request for competitive proposals. The U.S. Department of Energy (DOE) intends to solicit a proposal and negotiate a sole source contract with L3 Communications Corporation to provide the Office of Health, Safety and Security with an extended maintenance agreement for X-Ray machines provided by L3 under a previous contract. The proposed maintenance agreement is to service the following Perkin-Elmer Detection Systems or L3 Communications Security and Detection Systems manufactured equipment: Model Number: Equipment SYS 222 Linescan 3 and SYS 210 Linescan 3. The contractor will be required to perform preventative/routine maintenance, and repair at the DOE Headquarters facilities, in Germantown, MD and Washington, DC. The statutory authority for permitting other than full and open competition for this contract is Section 303[c][1] of the Federal Property and Administrative Services Act of 1949, as amended by the Competition in Contracting Act, 10 USC 2304[c][1], and implemented by FAR 6.302-1[b][2], which authorizes other than full and open competition when there is only one responsible source and no other supplies or services will satisfy agency requirements; when the existence of limited rights in data, patent rights, copyrights, or secret processes; the control of basic raw material; or similar circumstances, make the supplies and services available from only one source. Industry expressions of interest must demonstrate the firm's ability to provide the items described above. Interested parties may submit a proposal and rati onale as to why they should be considered within fifteen (15) days of this notice via Fedconnect, the new Headquarters DOE prism based procurement system that utilizes a centralized location for the issuance of solicitations and receipt of proposals called Fedconnect. Any adjustments to the acquisition strategy for this proposed contract based upon responses to this notice is solely within the discretion of the Government. The North American Industry Classification System (NAICS) Code for this requirement is 811219. The anticipated period of performance of this contract is for a total of three years, consisting of one 12-month base period and two 12-month option periods.
