- . Pension Benefit Guaranty Corporation (PBGC), 1200 K Street, NW, Washington DC 20005, intends to negotiate GSA Scheduled agreement, pursuant to FAR 6.302-1 and untilizing the Simplified Acquisition method described in FAR 13.106 with Four Points Technology to provide support and maintenance to PBGC for Pointsec for PC FDE & Pointsec Device Protector. This notice is not a request for competitive quotes. However, statements of capability to fulfill this requirement received from other responsible businesses prior to close of business on August 4, 2009 will be evaluated, for purposes of determining whether to conduct a competitive procurement. This Limited Source Justification is provided as required by FAR 8-405-6 (1) IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY. Pension Benefit Guaranty Corporation (PBGC), Procurement Department, 1200 K Street NW, Suite 1090, Washington, DC 20005-4026. (2) NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED. This J&A is for the procurement of PointSec Software Maintenance currently in use. PBGC anticipates the issuance of a firm-fixed price contract for the purchase of PointSec Software maintenance. (3) A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS (INCLUDING THE ESTIMATED VALUE OF ACTION). PointSec Software is used at PBGC for security of mobile devices. This application is critical to PBGC’s security infrastructure. This maintenance support will ensure PBGC meets external financial auditing requirements and meets critical Corporate strategic and business objectives. (4) A DEMONSTRATION OF THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED. PointSec Software was reviewed and selected based on a wide review of other similar applications over four years ago. Currently this software is integrated into key corporate security programs within the Corporation. Although other similar applications are available, the cost to change security processes and revamp the work processes would be too costly. Awarding to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. By retaining the PointSec Software, the cost and mission impact of migrating to another vendor’s products can be avoided. (5) A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE. The contracting officer will perform a price analysis to ensure the cost to the government will be fair and reasonable. This information shall be ascertained by review of current prices or recent contracts for similar services. (6) A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED. Market research was conducted via the internet to locate resellers offering the requested service. The market research has revealed multiple vendors. (7)ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION. PointSec Software is a key component within the Corporation infrastructure and supports a wide range of Corporate security operations. Therefore, the maintenance on this software is critical to Corporate operations. (8) A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED IN WRITING, AN INTEREST IN THE ACQUISITION. (9)A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED. PBGC will continue to evaluate other similar products. As different capabilities are developed and/or mission requirements change, PBGC will reevaluate its choice of this application.
