Description
The Department of Commerce National Oceanic and Atmospheric Administration (NOAA)/National Marine Fisheries Service, Gloucester, MA 01930 is issuing notice of intent to negotiate a sole source procurement with RJE International of Irvine CA to provide a Pinger Receiver Location System for use in enforcing the Harbor Porpoise Take Reduction Plan Pinger Requirements. NOAA's Harbor Porpoise Take Reduction Plan requires the use of acoustic deterrent devices ( pingers) on sink gillnet gear during specific times and areas off the coast of New England for the protection of the porpoises. RJE is the only vendor who has produced a device, The PRS -275, that is rugged and durable enough to withstand the harsh marine environment and can detect the 10 kHz sound emitted by the pingers. The PRS -275 is specifically designed for direct placement in the ocean in order to detect the pinger's sound.. This device will aid enforcement efforts by allowing enforcement officers to determine the presence or absence of pingers while gillnets are in the water. At sea trials of the PRS -275 have been conducted and the device was able to detect the sound of the pingers that were placed in the water to depths of approx. 100 fathoms. Most of the Plan management areas occur in areas where the depths are likely 100 fathoms or less. The requirement is necessary to support NMFS mission to provide assistance in developing resolutions for the advancement of healthy and populated marine species for the betterment of fishing communities, healthy human consumption, and recreational engagement. The statutory authority is 41 US 253(c)(1), Only One Responsible Source. The government intends to award a firm-fixed price purchase order for this requirement. The proposed contract action is for supplies and services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302(c)(1). The applicable NAICS code is 334290 and the size standard is 750,000,000. All applicable awards shall be in compliance with Homeland Security Presidential Directive 12 (HSPD-12). CAR Clause 1352.239-73 Security Processing Requirements for Contractors/Subcontractor personnel for accessing DOC information Technology Systems (JUN 2006) will apply. Interested parties may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Responses shall be submitted by 11:00 a.m. Eastern Standard Time August 12, 2009. This notice of intent is not a request for competitive proposals.
