- The Pension Benefit Guaranty Corporation (PBGC) intends to enter into a Sole Source GSA Schedule agreement, pursuant to FAR 6.302-1 and utilizing the Simplified Acquisition method described in FAR 13.106, with Achieve Global to provide 300 sets of student training materials to supplement the material that PBGC have in inventory. The proposed contract is for services for which the government intends to solicit and negotiate with only one source under the authority of FAR 13.106 and 6.302-1. This is not a Request for Quote (RFQ), but a Notice of Intent. No RFQ will be issued. Interested parties may, however, request further information (no later than July31, 2009) by email to Contract Specialist Jeannie Dyson at Dyson.Jeannie@PBGC.Gov. This Limited Source Justification is provided as required by FAR 8-405-6 (1) IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY. Pension Benefit Guaranty Corporation (PBGC), Procurement Department, 1200 K Street NW, Suite 1090, Washington, DC 20005-4026. (2) NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED. This J&A is for the procurement of support for the purchase of 300 sets of student training materials. Pension Benefit Guaranty Corporation has invested in certification and training of this methodology within the organization. By continuing to utilize the methodology that is in place, the Return on Investment grows and the original investment continues to be of value. (3) A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS (INCLUDING THE ESTIMATED VALUE OF ACTION). Several years ago PBGC invested heavily in a premier customer service training program designed by Achieve Global. Initially, everyone in the corporation, contractors and federals, was required to take this training. Refresher training was provided in 2005/2006 and at that time the training materials were customized exclusively for PBGC. This refresher training was offered primarily to front line employees in the Field Benefit Administration offices and the Customer Contact Center. Recently, BAPD requested that SPED again provide refresher training for its front line employees, targeting the Field Benefit Administration offices and the Customer Contact Center, as well as the federal staff. To complete the training will require that we purchase approximately 300 sets of student training materials to supplement the materials that we have in inventory. We would like to contract with Achieve Global to purchase these training materials as they are the only vendor that can provide them. (4) A DEMONSTRATION OF THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED. - Achieve Global, as part of the initial contract, was engaged to train and certify a cadre of federal employees to deliver the training. Most of those employees are still with PBGC and will lead this refresher training. - The training request represents continuation of an existing program and strategy to promote a culture of customer service. The training materials were designed to support accomplishment of exceptional service-a PBGC strategic goal. The training program establishes consistency in customer service expectations throughout the organization. - The materials used in the PBGC customer service training were developed by Achieve Global, and the vendor has maintained a copyright on the training materials. The training materials contain Achieve Global's (adjective) regular customer service curriculum. Specific examples from the PBGC work environment are documented in the exercises and workbooks. Awarding to any other product line would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. By retaining the product line, the cost and mission impact of migrating to another vendor's products can be avoided. (5) A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE. The contracting officer will perform a price analysis to ensure the cost to the government will be fair and reasonable. This information shall be ascertained by review of current prices or recent contracts for similar services. (6) A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED. Market research was not conducted do to the fact that Achieve Global designed a customer service training program for PBGC in 2005/2006. (7) ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION. Achieve Global is a key component within the Corporation infrastructure and supports a wide range of Corporate activities. Therefore, these products are critical to Corporate operations. (8) A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED IN WRITING, AN INTEREST IN THE ACQUISITION. (9) A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED. PBGC will continue to evaluate other similar products. As different capabilities are developed and/or mission requirements change, PBGC will reevaluate its choice of this application.
