- Description
- The Department of Commerce, National Institute of Standards and Technology (NIST) intends to negotiate on a fixed price purchase order on a sole source basis with Energy Solutions, Salt Lake City, Utah under Other than Full and Open competition by the authority of the Federal Acquisition Regulation(FAR) subpart 6.302-1, Only one source and no other supplies or services will satisfy the agency requirement. The sole source determination is based on the need for the transport and utilization of biosolids from a waste water treatment plant (WWTP) as overfill material at a licensed 10CFR61 disposal site only owned by Energy Solutions, Salt Lake City, UT. The material, not considered radioactive or hazardous, to be transported is approximately 235 tons of EQ Biosolids from a municipal WWTP. This vendor has unique and proprietary capabilities since NIST requires the material be used as non-hazardous overfill at a licensed 10CFR61 disposal site and the only operational 10CFR61 disposal site that can receive this material is owned and operated by Energy Solutions. Therefore, this is the only organization that can provide these services and no other company has the proprietary knowledge or capability to provide these services. A solicitation package will not be issued. This notice of intent is not a request for competitive quotations; however, the government will consider other responses received by August 5, 2009. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
