COMBINED SYNOPSIS/SOLICITATION Publication Disclosure This action has been identified as being funded under the American Recovery and Reinvestment Act, PL. 111-5 (February 17, 2009) (ARRA). For each such government contract, DOL is required to post certain details of the contract on DOL’s website, which is linked to Recovery.gov via the award number. For contracts over $500,000, DOL is also required to post a summary of the contract. (I) Recovery Act ----- This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (II) This solicitation document is issued as a request for proposal (RFP). Submit written proposals on RFP number DOL099RQ20752. (III) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-35, effective 15 July 2009. (IV) There is no set aside for this procurement. The associated NAICS code is 721110. The small business size standard is $6.5M. (V) This combined solicitation/synopsis is for purchase of the following commercial services: SCOPE OF NON PERSONAL SERVICE I.Requirements: A.Require a hotel facility in the Washington, DC metropolitan area to host a 1-day OFCCP National ARRA Forum to be held on Wednesday, September 9, 2009 from 8AM-6PM. B.Require a large conference room that can accommodate 200 attendees in a school room setup for the General Session and 3 breakout rooms for training purposes that can accommodate 40 attendees each in a hollow square or school room set up. The large conference room should have capability to be used as a breakout room. The large conference room and breakout rooms should be in close proximity. C.Require in close proximity to meeting space the availability for attendees to purchase food and beverages at specified break times during the forum. D.Require in close proximity to large conference and break out rooms space to display floor exhibit designed to fit 8’ x 8’ floor space. E.Require audio visual equipment and materials to facilitate the training conference. This includes: •4 LCD Projectors •4 Tripod Screens •4 Laptop Computers •8 wireless microphones •4 flip charts •4 flip chart pads, post-it •4 packages, assorted markers •4 wireless mouse •4 laser pointers •Miscellaneous audio and video peripherals needed for equipment Deliverable - Releasable Copies - Freedom of Information Act The Freedom of Information Act (FOIA) permits withholding information under several exemptions, including Exemption 4 which protects “trade secrets and commercial or financial information obtained from a person [that is] privileged or confidential,” 5 U.S.C. § 552(b)(4). Within 5 business days of contract award, the contractor shall provide a statement that the contract is available for full disclosure under the FOIA or provide a scanned PDF of the redacted copy of the contract identifying the specific portions the contractor believes are covered by the particular exemption requested. Any redactions must be fully supported under the FOIA. In the event the Government notifies the contractor that it does not agree with a proposed redaction, the contractor shall have 5 business days to submit additional information to support the requested redaction. For subcontracts, within 5 business days of the contractor’s award of any subcontract over $500,000 the contractor shall provide the Government a scanned PDF copy of the subcontract with a statement that the copy is either available for full disclosure, or identifying the specific portions believed to be covered by the particular exemption requested. Redactions should be limited to those protections provided under the FOIA. Following the procedures above, the Government has the right to notify the contractor of any disagreement with proposed redactions or exemption requests. (VI) The provision at FAR 52.212-1, Instructions to Offerors – Commercial, applies to this acquisition. (VII) The offeror must submit a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items (Nov 2007), with its quote. (VIII) The clause at FAR 52.212-4, Contract Terms and Conditions - Commercial Items (March 2009) with addendum, applies to this acquisition. (IX) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (June 2009) applies to this acquisition.
