Department of MemorandumVeterans Affairs Date: July 14, 2009 From:VA Heartland Network Contracting (10N15-90) Subj:Justification and Approval for Veteran Owned Small Business Sole-Source Set-Aside IAW P.L. 109-461 To:FILE 1. IDENTIFICATION AND DESCRIPTION OF ACTION BEING APPROVED: This action is based on a requirement for Patriot Hospital Bed Systems for the Marion VAMC, being procured in accordance with the Federal Acquisition Regulation (FAR). It is being sole-sourced for a Veteran Owned Small Businesses (in accordance with P.L. 109-461, Sec. 8127, paragraph d., 38 U.S.C. 8127), Alliant Enterprises, LLC, DBA Alliant Healthcare Products. 2.DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED: The contract is for the purchase of 11 each S3 Patriot Hospital Bed Systems. The total contract value is $130,933. 3.IDENTIFICATION OF STATUTORY AUTHORITY: The requirement will be procured under P.L. 109-461, Sec. 8127. 4. DEMONSTRATION THAT THE ACQUISITION REQUIRES USE OF AUTHORITY CITED: Pursuant to 38 U.S.C. 8127(c), contracting officers may use other than competitive procedures (including sole-source awards) for contracts to VOSBs where the anticipated price will exceed the Simplified Acquisition Procedures threshold but not to exceed $5,000,000 (including options). 5. DEMONSTRATION THAT THE ANTICIPATED COST WILL BE FAIR AND REASONABLE: The procurement will be compared to previous purchases of this same bed system when it was covered under an FSS contract, as well as other bed systems available. 6. CONTRACTING OFFICER'S CERTIFICATION: "I certify that the facts and representations under my cognizance which are included in this Justification and Approval are accurate and complete to the best of my knowledge and belief." /es/ Donald J.
