- This is a combined synopsis/solicitation/notice of intent for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is 1158000 and the solicitation is being issued as a Notice of Intent on a sole source basis in accordance with the Simplified Acquisition Procedures FAR 13.106(1)(b). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-35. This acquisition is a small business set aside. The North American Industry Classification System (NIACS) code is 334516 and the business size standard is 500 employees. The National Institute on Drug Abuse on behalf of the National Institute of Neurological Disorders and Stroke (NINDS) has a requirement for one ImageStream® System and Instrument upgrades. The ImageStream system is manufactured by Amnis Corporation and sold exclusively by Amnis Corporation in the U.S. The technology is Amnis' proprietary products and not available from other sources. Amnis provides all parts, labor, supplies, installation, training, and standard warranty. Funding for this requirement is American Recovery and Reinvestment Act (ARRA). FAR provisions and clauses, including AARA contract clauses that apply to this acquisition: The provision at 52.212-1, Instructions to Offerors-Commercial, FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders, Commercial Items, FAR 52.225-1, Central Contractor Registration, and FAR 52.232-33, Payment by Electronic Funds Transfer - Central Contractor Registration. This is not a solicitation for competitive quotations. However, all responsible sources may submit an offer that will be considered by the Agency. All information furnished shall be in writing and must contain sufficient detail to allow the Agency to determine if it can meet the above unique specifications described herein. Offer must be submitted on or before 1:00 PM Eastern Standard Time Tuesday, July 28, 2009 to Liem T Nguyen, ln18x@nih.gov. A determination by the Government not to compete this proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. In order to receive an award, contractors must have valid registration/certification in the Central Contractor Registration (CCR) www.ccr.gov and the Online Representations and Certifications Applications (ORCA), http://orca.bpn.gov.
