- This is a combined synopsis/solicitation/Notice of Intent for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are not being requested and a written solicitation will not be issued. The solicitation number for this acquisition is NOI9108 and is being issued as a Notice of Intent. The incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-33. This acquisition will be processed under Simplified Acquisition Procedures (SAP) and is not a small business set-aside. The associated North American Industry Classification System (NAICS) Code 339999, which has a business size standard of 500. The National Institutes of Health, National Institute of Allergy and Infectious Diseases intends to procure a FACSCANTO 405 nm Violet Laser upgrade on a sole source basis from Becton Dickinson and Company. An additional laser is needed to allow for eight color flow cytometry. The proposed upgrade will add functionality to the existing FACSCanto flow cytometer by increasing the number of features and areas of interest on each cell type under investigation. The current configuration of the instrument allows for study of six dyes on each cell simultaneously. The violet laser upgrade will add two additional colors that can be detected and the system must be compatible with all existing hardware and software. The contractor must be able to supply a standard warranty and maintenance agreement for the entire system. BDBiosciences, manufacturer of the existing FACSCanto flow cytometer does not use distributors therefore, this is the only known company that manufactures a laser that fits in the FACS CANTO. The following instrument and products may be acquired under this acquisition: Item/Description/Quantity - 1) Kit Upgrade FACSCANTO II - Quantity 1. The following factors shall be used to evaluate offers: 1) price, 2) warranty, and 3) technical capability to meet required specifications. Place of delivery NIH/NIAID, Bethesda, Maryland, 20892. The government will award a fixed price purchase order to the responsible contractor. The technical issues will receive paramount consideration in the selection of the Contractor for this acquisition. All evaluation factors, other than cost or price, when combined are significantly more important than cost or price. However, cost/price may become a critical factor in source selection in the event that two or more offerors are determined to be essentially equal following the evaluation of all factors other than cost or price. The government intends to make an award to that offeror whose proposal provides the best overall value to the Government. The following FAR provisions and clauses apply to this acquisition: Buy American Act- Supplies; FAR 52.204-7; FAR 52.212-1 Instructions to Offerors Commercial Items; FAR 52.212.3 Offeror Representations and Certifications Commercial Items; FAR 52.212-4 Contractor Terms and Conditions Commercial Items; FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items. All responsible sources may submit a bid, proposal, or quotation that will be considered by the agency. Small and disadvantage businesses are encouraged to submit a quotation for this requirement. Offerors must include with their offer a completed copy of the provisions at FAR 52.212-3, Offerors Representations and Certifications - Commercial Items. Offers must be submitted no later than 5:00 PM Eastern Daylight Time (EDT) July 16, 2009 to Ms. Patricia Fields. For delivery through the Postal Service, the address is NIH/NIAID/AMOB, 10401 Fernwood Drive, Suite 2NE52B/MSC 4812, Bethesda, Maryland 20817- 4812. Electronic submission will not be accepted. In order to be considered for an award, offeror must have completed the online electronic Representations and Certifications located at http://orca.bpn.gov/ in accordance with FAR 4.1201(a).
