- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITIONDEPARTMENT OF VETERANS AFFAIRS MEDICAL CENTER FARGO, NORTH DAKOTA 58102 DATE: June 26, 2009 PROJECT TITLE: Bldg 3 Stairs and Bldg 5 Demolition, Fargo VAMC SOLICITATION: VA-263-09-RP-0225 CONTRACTOR: 3ND Inc 1404 33rd Street SW Fargo, ND 58103 GOVERNMENT ESTIMATE: $400,000.00 PROJECT DESCRIPTION: The Department of Veterans Affairs Medical Center, Fargo, ND, requires the Building 3 Stairs to be replaced and Building 5 to be demolished to provide more parking. AUTHORITY FOR SOLE SOURCE JUSTIFICATION: FAR 6.302-5(b)(6) Authorized or required by statute. JUSTIFICATION 38 U.S.C. 8127 provides authority to the Department of Veterans Affairs to engage in sole source acquisitions with Service Disabled Veteran Owned Small Businesses (SDVOSB) and Veteran Owned Small Businesses (VOSB). Per FAR 5.202(a)(4), a synopsis is not required. 3ND Inc is listed online at vetbiz.gov; no additional market research was conducted. 3ND Inc with its purchase of C.S. DuBois is an experienced healthcare facility construction contractor with the experience, equipment, and personnel to satisfactorily accomplish this project in a timely and cost effective manner. 3ND has purchased C.S DuBois Construction that has a long history of excellent performance at the Fargo VAMC, North Dakota. They consistently provide proposals that are competitive with the Government Estimate. APPROVAL This procurement action is necessary and I certify that this justification is accurate and complete to the best of my knowledge and belief.
