- SWFSC J&A COMPETITION IN CONTRACTING ACT (CICA) JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY: National Oceanic and Atmospheric Administration (NOAA) Office of the Chief Administrative Officer (OCAO) 2. DESCRIPTION OF THE ACTION BEING APPROVED: Procurement of a no-cost lease with The Regents of the University of California for land at the San Diego Campus in La Jolla for a term not less than 55 years. 3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET AGENCY'S NEEDS, INCLUDING ESTIMATED VALUE: Leasehold interest of approximately 3.305 acres of unimproved land. $6.6M 4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION: 41 USC 253(c)(5) -- Authorized or required by statute. 5. DEMONSTRATION THAT PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS REQUIRES USE OF THE AUTHORITY CITED: 119 STAT. 2313 "the Secretary of Commerce is authorized to enter into a lease with The Regents of the University of California for land at the San Diego Campus in La Jolla for a term not less than 55 years" 6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS WERE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE: See discussion in 8 below. Notice of the proposed contract action will not be made available in accordance with the exception FAR 5.202(a)(10). 7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE: This action will be at no-cost. 8. DESCRIPTION OF THE MARKET SURVEY CONDUCTED AND RESULTS: Following a 1997 DOC OIG report that recommended changes to NMFS laboratory structure, NOAA examined other potential viable locations. The sites considered consisted of existing NOAA sites that could potentially meet NOAA's needs, including seawater access. No other sites were identified. 9. OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION: Capacity at other NOAA facilities in California does not exist and investments would be required to relocate/consolidate functions presently at La Jolla at other locations. Existing research partnerships among UCSD, the Scripps Institute of Oceanography, the Inter-American Tropical Tuna Commission, and other local partners. 10. LISTING OF SOURCES THAT EXPRESSED A WRITTEN INTEREST IN THE ACQUISITION: None. 11.
