- The U.S. Department of State, Office of Acquisition, intends to award a sole source award to GKN Aerospace Transparency Systems due to the specialized nature of the requirement. This firm has specialized knowledge of the specific dimensions of all vehicles at overseas posts. The replacement glass is required for repair of the vehicles in order to meet the Department's specification. The statutory authority permitting other than full and open competition is 41 U.S.C.253(c) and FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of agency and contracting activity. It is recommended that the Department of State use other than full and open competition under only one responsible source and no other sources or supplies will satisfy agency requirements to procure replacement ballistic glass for installation in armored vehicles at overseas Posts. The estimated cost will be $,133,620.00. 2, Nature and/or description of the action being approved. The Department of State (DOS) requires ballistic transparent armor glass in its fleet of Government-owned fully and light armored vehicles, The Bureau of Diplomatic Security (DS) is responsible for ensuring that the armored glass installed in the vehicles meets the Department's specifications, The armored glass purchased by this contract will allow routine repair of the vehicles. 3. A description of the supplies or services required to meet the agency's needs. The Bureau of Diplomatic Security requires replacement ballistic glass for the following vehicle makes and models: Levels C & D, large sedan: Cadillac Deville and BMW 750IAL, Levels C & D, large carry-all: Chevrolet and GMC Suburbans, Levels C & D, large sedan: Cadillac Deville, Ford Crown Victoria, Lincoln Town Car, Levels C & D, large carry-all: Chevrolet and GMC Suburbans. Chevrolet Tahoe, GMC Yukon, Ford Expedition, Ford Excursion, Toyota Landcruiser, Level C, large Carry-all van: Chevrolet 0-30 Sport Van and Ford E350 Club Wagon. 4,. Identification of the statutory authority permitting other than full and open competition. The statutory authority permitting other than full and open competition is 41. U.S.C.253© and FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. 5, A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. DS has a requirement for the replacement glass which is required as part of an ongoing maintenance program to replace glass that no longer meets Department requirements for strength, protection, and visual clarity. GKN Aerospace Transparency Systems is the sole provider of ballistic glass to the company which armored vehicle. Because of the unique relationship to the vehicle armoring company, this vendor is the sole source provider of ballistic glass for the repair of these vehicles. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. Requirement will be publicized, as required by FAR 5,2. 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer determines the price will be fair and reasonable based cost previously accepted and approved purchases for similar items that have been competed and awarded. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted, Market research revealed numerous manufactures of ballistic glass but the armorer of the vehicles uses a specific vendor for their windows. Each glass vendor must be qualified to produce glass for the specific design type. 9. Any other facts supporting the use of other than full and open competition. None. 10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. None, Because of the uniqueness of the product, no other vendors have been identified or contacted. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
