- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 of the Federal Acquisition Regulation (FAR), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Quotes are being solicited and a written solicitation will not be issued. Solicitation number W912L7-09-T-0030 is hereby issued as a Request for Quote. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-31. The Tennessee Army National Guard has the following requirements. This requirement is being advertised as a small business set-aside; the North American Industry Classification System (NAICS) Code is 332420 with a Small Business Size Standard of five hundred (500) employees. All responsible sources may submit an offer, which shall be considered by this Agency. The following clauses are applicable to this acquisition: FAR 52.212-1 Instructions to Offerors-Commercial Items, FAR 52-212-2 Evaluation Commercial Items, FAR 52.212-3 Offeror Representations and Certifications-Commercial Items, FAR 52.212-4 Contract Terms and Conditions-Commercial Items, FAR 52.212-5 (Dev) Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items (JUN 2006) (Deviation), FAR 52.225-1 Buy America Act Supplies and DFARS 252.212-7001 Contract Terms, Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items (JUL 2006) (Deviation). Quotes are due in this office no later than Wednesday, April 1, 2009, close of business four thirty (4:30) p.m. local central daylight time. They can be emailed to Randal.Halbrooks@ng.army.mil or facsimile to 615-313-0562. Offers will be evaluated using the Lowest Priced Technically Acceptable criteria in accordance with FAR 15 and FAR 13. The award will be made to the vendor whose proposal is most advantageous to the Government. Containers shall be brand name or equal to the 40'L x 8.5'H x 8'W Standard forty-foot ISO Shipping/Storage Container (CONEX) reconditioned by Nationwide Containers. Containers must contain the following salient characteristics to be considered technically acceptable for this requirement: The outside of the containers shall have a fresh coat of paint showing no signs of rust, or any scratches more than one eight of an inch wide or five inches long, color desert tan, all hinges and fastening devices shall function as a new container would, wooden floors shall show no signs of deterioration that would impair the functionality of the container; containers shall have metal shroud mounted over all locking hasps to prevent the use of bolt cutters during an attempted forced entry, only minor overall damage shall be acceptable, containers may have dents but they may be no more than six inches wide and one inch deep and shall not be visible in any way on the opposite side of the container wall. Vendor shall also provide all material handling equipment necessary to unload the shipping containers at the designated location, i.e. roll-back trailer or crane. The Government desires delivery within ninety (90) days, vendors shall include a delivery schedule in their response to this request for quote. Past Performance will not be an evaluation factor in this acquisition. Point of Contact referencing this solicitation is Randal Halbrooks at 615-313-2628. Vendors who respond to this solicitation shall submit a price per container and a total delivered price for all containers. Vendors shall submit sufficient descriptive literature to determine whether or not their proposed containers meet each of the salient characteristics described above; vendors who fail to submit proper descriptive literature may be deemed technically unacceptable without further discussion. Vendors shall submit a letter specifically certifying the country of origin for the containers offered in this solicitation. If the vendor certifies that their product comes from a qualifying country as described in the Defense Federal Acquisition Regulation Supplement (DFARS) subpart 225.872-1 the Government shall rely on this certification and assume that all products offered shall be from the country indicated on the certification. If after award, the Government determines the country of origin was misrepresented, the Government may take action in accordance with FAR subpart 9.406-2.
