- The proposed action is for requirements which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302, as an Urgent and Compelling action. Interested persons may identify their interest and capability to respond to the requirement. This notice of intent is not a request for competitive proposals. However, all proposals received prior to 30 March 2009 will be considered by the Government. A determination by the Government not to compete this proposed action based upon responses to this notice is solely within the discretion of the Government. This solicitation VA-261-09-RQ-00160 is issued as an Urgent and Compelling Request for Quote (RFQ). The North American Industry Classification System (NAICS) number is 423450. This Urgent and Compelling requirement closes and is due back to Christine.a.peterson3@va.gov by 2:00 p.m. Pacific time, 30 March 2009. Justification and Approval (J&A) for Other than Full and Open Competition FOR Urgent and Compelling Emergency bridge Contract Subject: VA-261-09-RP-0160/Custom Surgical Packs for VA Facility Medical Centers CONTRACTING AGENCY: Department of Veterans Affairs VISN 21 Consolidated Contracting Activity (CCA). 2. DESCRIPTION OF ACTION: VISN 21 VA Medical Centers have an urgent and compelling need for the continuation of the production and distribution of their Custom Surgical Packs. Previously this requirement was under contract five separate contracts - utilizing two separate Vendors. Currently the National Contracting Agency (NAC) is in the process of preparing a Blanket Purchase Agreement (BPA) that will provide this requirement for all facilities for the next five years. The NAC has stated that it will likely take two to three months to review all of the sources. In other words the process will take longer than originally anticipated. Therefore a temporary Bridge Contract is being implemented to provide for these requirements. 3. DESCRIPTION OF REQUIREMENT: Urgent and Compelling Emergency requirement under FAR 6.302-1 (iii). Custom Surgical Packs are available from the original sources by which they are custom manufactured. Items are required for all of VISN21 Surgical Services. These Custom Surgical Packs are best provided and made available as a follow on contract. The Custom Packs are produced for each facility to strict specifications and can not be purchased off the shelf. The continuing manufacturing and distribution of the currently produced Custom Surgical Pack would be the most advantageous method for the Government to use. Substantial duplication of cost to the Government would occur and those costs would not be retrieval through any form of open competition. It has been determined that it would take approximately 120 days to produce new Surgical Packs by other sources. This is an unacceptable delay since the Surgical Packs will be required on a daily basis. It was anticipated that the NAC could accomplish the requirement in time but do to unforeseen complications the date was pushed out to April 2009. 4. DESCRIPTION OF SUMMARY OF REQUIREMENTS: Vendor is required to provide aforementioned Custom Surgical Packs as described in #3 above. Estimated value of requirement this requirement for three (3) months is: $393,072.00 5. AUTHORITY CITED: FAR 6.302-2 6. REASON FOR AUTHORITY CITED: Would adversely affect patient care in that surgeries could not be performed without the surgical packs. The agency's need for the surgical packs is of such an unusual and compelling urgency that the Patients would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for. 7. EFFORTS TO OBTAIN COMPETITION: N/A, per #5 above. 8. FAIR AND REASONABLE PRICE DETERMINATION: A Price Negotiation Memorandum will be prepared which will detail the actions taken by the Contracting Officer to ensure fair and reasonable pricing. 9. MARKET SURVEY/RESEARCH: N/A 10. OTHER FACTORS: N/A 11. INTERESTED SOURCES: N/A 12. AGENCY ACTIONS TO INCREASE COMPETITION: Action to implement a competitive, open market Request for Proposal is already underway. This will succeed the temporary bridge contract on or about June 1, 2009. 13.
