- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation is being posted in accordance with FAC 05-26 as an Unrestricted Requirement under NAICS 562212. The Missouri Army National Guard has a requirement for Pickup and Disposal/Recycling of approximately 2500 wet-cell commercial vehicle batteries from 16 FMS/CSMS locations throughout the State of Missouri. Locations are as follows with all locations in the State of Missouri: Jefferson City, Raytown, Festus, Cape Girardeau, Poplar Bluff, Rolla, St. Joseph, Marshall, Mexico, Macon, St. Louis, Springfield, Harrisonville, Neosho, Trenton and Nevada. Each location should have the ability to contact the vendor to schedule pickup. Vendor will provide a Letter of Indemnification for the battery disposal. Questions regarding the soliciation can be emailed to 1LT Timothy Kohls at timothy.kohls@us.army.mil. Quotes are due by 10:00 AM central time on 30 March 2009. Quotes should outline the cost for pickup or the dollar amount that will be paid per battery to the Federal Government. Quotes should be submitted to timothy.kohls@us.army.mil. The following provision and clauses are applicable to this solicitation/award: 52.204-7 Central Contractor Registration; 52.212-1 Instructions to Offerors--Commercial Items; 52.212-3 Offeror Representations and Certifications--Commercial Items (vendor must complete print ed copy and submit with quote); 52.223-5 Pollution Prevention and Right-to-Know Information; 52.223-10 Waste Reduction Program; 52.228-5 Insurance- Work on a Government Installation; 52.237-2 Protection of Government Buildings, Equipment, and Vegetation; 52.245-1 Government Property; 52.245-2 Government Property Installation Operation Services; 52.245-9 Uses and Charges; 52.246-4 Inspection of Services--Fixed Price; 252.201-7000 Contracting Officer's Representative; 52.212-2 EVALUATION--COMMERCIAL ITEMS JAN 1999 (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:The Government shall award a contract to the offeror that can provide a technically acceptable service. Vendors must provide documentation of their ability to meet all requirements of this solicitation. The contractors past performance shall be evaluated for delivery/service as well as customer service. The vendor must provide three references, to include name of agency/company, telephone number, and Point of Contact name. The last evaluation criteria will be competitive pricing. Technical and past performance, when combined, are equal to pricing. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option. c. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer or part of an offer, whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. 52.212-4 CONTRACT TERMS AND CONDITIONS-- COMMERCIAL ITEMS OCT 2008 52.223-3 HAZARDOUS MATERIAL IDENTIFICATION AND MATERIAL SAFETY DATA JAN 1997 ALTERNATE I JUL 1995 a. Hazardous material, as used in this clause, includes any material defined as hazardous under the latest version of Federal Standard No. 313 including revisions adopted during the term of the contract. b. The offeror must list any hazardous material, as defined in paragraph a. of this clause, to be delivered under this contract. The hazardous material shall be properly identified and include any applicable identification number, such as National Stock Number or Special Item Number. This information shall also be included on the Material Safety Data Sheet submitted under this contract. Material Identification No. If none, insert None ___________________ ___________________ ___________________ ___________________ ___________________ ___________________ (c) This list must be updated during performance of the contract whenever the Contractor determines that any other material to be delivered under this contract is hazardous. (d) The apparently successful offeror agrees to submit, for each item as required prior to award, a Material Safety Data Sheet, meeting the requirements of 29 CFR 1910.1200(g) and the latest version of Federal Standard No. 313, for all hazardous material identified in paragraph (b) of this clause. Data shall be submitted in accordance with Federal Standard No. 313, whether or not the apparently successful offeror is the actual manufacturer of these items. Failure to submit the Material Safety Data Sheet prior to award may result in the apparently successful offeror being considered nonresponsible and ineligible for award. (e) If, after award, there is a change in the composition of the item(s) or a revision to Federal Standard No. 313, which renders incomplete or inaccurate the data submitted under paragraph (d) of this clause, the Contractor shall promptly notify the Contracting Officer and resubmit the data. (f) Neither the requirements of this clause nor any act or failure to act by the Government shall relieve the Contractor of any responsibility or liability for the safety of Government, Contractor, or subcontractor personnel or property. (g) Nothing contained in this clause shall relieve the Contractor from complying with applicable Federal, State, and local laws, codes, ordinances, and regulations (including the obtaining of licenses and permits) in connection with hazardous material. (h) The Government's rights in data furnished under this contract with respect to hazardous material are as follows: (1) To use, duplicate and disclose any data to which this clause is applicable. The purposes of this right are to-- (i) Except as provided in paragraph (i)(2), the Contractor shall prepare and submit a sufficient number of Material Safety Data Sheets (MSDS's), meeting the requirements of 29 CFR 1910.1200(g) and the latest version of Federal Standard No. 313, for all hazardous materials identified in paragraph (b) of this clause. (1) For items shipped to consignees, the Contractor shall include a copy of the MSDS's with the packing list or other suitable shipping document which accompanies each shipment. Alternatively, the Contractor is permitted to transmit MSDS's to consignees in advance of receipt of shipments by consignees, if authorized in writing by the Contracting Officer. (2) For items shipped to consignees identified by mailing address as agency depots, distribution centers or customer supply centers, the Contractor shall provide one copy of the MSDS's in or on each shipping container. If affixed to the outside of each container, the MSDS's must be placed in a weather resistant envelope. (ii) Obtain medical treatment for those affected by the material; and (iii) Have others use, duplicate, and disclose the data for the Government for these purposes. (2) To use, duplicate, and disclose data furnished under this clause, in accordance with subparagraph (h)(1) of this clause, in precedence over any other clause of this contract providing for rights in data. (3) The Government is not precluded from using similar or identical data acquired from other sources. 52.252-1 SOLICITATION PROVISIONS INCORPORATED BY REFERENCE (FEB 1998) This solicitation incorporates one or more solicitation provisions by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The offeror is cautioned that the listed provisions may include blocks that must be completed by the offeror and submitted with its quotation or offer. In lieu of submitting the full text of those provisions, the offeror may identify the provision by paragraph identifier and provide the appropriate information with its quotation or offer.
