Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This solicitation is issued as Request for Quotes (RFQ) #246-09-Q-0021. This procurement is a 100% small business set-aside under NAICS code 621391 with a standard business size of $7 million. Contractor shall provide a firm-fixed rate (all inclusive to include travel and per diem) for 51 eight-hour clinics, April 7, 2009 to April 6, 2010, with a FOUR-year option to extend services. Propose pricing for (base year): April 7, 2009 to April 6, 2010; Option Year 1: April 7, 2010 to April 6, 2011, Option Year 2: April 7, 2011 to April 6, 2012; Option Year 3: April 7, 2012 to April 6, 2013; Option Year 4: April 7, 2013 to April 6, 2014. Estimated start date is April 7, 2009. The closing date for receipt of quotes is March 25, 2009. Offers shall be submitted to the Oklahoma Area Indian Health Service, 701 Market Drive, Oklahoma City, Oklahoma 73114, no later than 4:30 p.m., on March 25, 2009. The offer must be submitted in a sealed envelope, addressed to this office, showing the solicitation number, and your name and address. Offers will also be accepted by fax at (405) 951-3771. Please do not email RFQ’s. Qualified vendors will review the following and submit applicable information. STATEMENT OF WORK The contractor shall provide fifty-one (51) Podiatry Clinics per year at the Health Center, Wewoka, Oklahoma. These clinics will be every Thursday between the hours of 8:00 a.m. – 5:00 p.m. from April 7, 2009 to April 6, 2010. The clinics shall include, but not be limited to the following: A. Obtain and/or review of clinical database relevant to the specialty problem including history, examination, diagnosis, and treatment of diseases as deformities of the foot in accordance with Indian Health Service Standards of Care. B. Treat conditions of the skin, such as excrescences, calluses, intractable plantar calluses, warts and thick deformed toenails. Diabetic related lesions such as neuropathic ulcers, infections, etc. C. Treat orthostatic deformities, such as flat feet, bunions, hammered toes, heel spurs. D. Provide notes for the medical record. E. TotalDebride Ulcer.7 – 1.2 cmExcision Benign Lesion 1.3 – 1.8 cmChemical destruction of Over 2.0 cmlesion DEF MINIMUM PROFESSIONAL QUALIFICATIONS: Contractor shall provide a doctor of Podiatry medicine who meets the following minimum professional qualifications and requirements: A.Current unrestricted license as a SPM in the State of Oklahoma. B.Graduate of an accredited College of Podiatry. C.Completed an approved residency in Podiatry. D.Completed application for and be awarded privileges at the Wewoka IHS Health Center (Attachment 1). E.It is recommended that proof of the above accompany offer to shorten evaluation time. F.Documentation of current Continuing Medical Education preferably related to Native American Diabetic Foot Problems. G.Have current medical insurance in the appropriate amount of $1,000,000 per occurrence and $3,000,000 aggregate. QUALITY OF PATIENT CARE: The contractor shall provide proper and adequate specialty clinic for eligible Indian patients serviced under the terms of this purchase order. Proper and adequate services for patient care shall be in accordance with standard podiatry medical practices and shall be equal in quality to services normally performed for the general public in a Joint Commission of Accreditation for health care organization accredited facility. All services shall be performed in accordance with the Quality Assurance Program, which is available at the IHS Health Center. INDEMNITY AND INSURANCE The Government assumes no responsibility for negligent acts of either the contractor of his/her employees; therefore, the contractor is responsible for obtaining that amount of professional liability insurance coverage that he/she considers appropriate. The contractor shall keep harmless and indemnify the government against any or all loss, cost damage, claims, expense or liability whatsoever resulting from performance of this purchase order. Contractor shall hold Federal Government and its agents including the Chief Executive Officer, Wewoka Indian Health Center and the government body immune from civil or professional liability for all acts related to quality care management and enforcement of this purchase order. RELATIONSHIP AND LIABILITIES OF PARTIES: INSURANCE REQUIREMENTS It is expressly agreed and understood the professional services rendered by the contractor are rendered in its capacity as an independent contractor, while this contract contains provisions to allow the Government to evaluate the quality of services provided, and for certain other administrative requirements, the Government retains no control over the professional aspects of the services rendered by the contractor including the contractor’s professional judgment and technical aspects of professional procedures; therefore, the contractor shall be solely liable for and liability producing act or omission by the contractor, employees of the contractor, subcontractors or agents of the contractor. ALTERNATE RESOURCES Contract Health Service: The contractor shall agree to file with third party resources (Medicare/Medicaid and private insurance) and accepts as payment in full reimbursement at rates, including deductible and co-payment for outpatient and inpatient physical services. The Indian Health Service is a residual resource and not an entitlement program. Therefore, in accordance with 42 CFR 36, payment for services provided to patients is not authorized when alternate resources for the provision of the payment for necessary medical services are available and accessible to the patient. GOVERNMENT FURNISHED FACILITIES, EQUIPMENT AND SUPPLIES: The Government will provide the facilities and equipment of the Wewoka IHS Health Center for use by the contractor in the provision of podiatry specialty clinics. The Government will provide supplies as necessary for use by the contractor for performance of podiatry specialty clinics. The Government will provide assistance in scheduling of patients and in requesting and receiving supplies. WORK SCHEDULE: The contractor shall provide fifty-one (51) Podiatry Clinics per year at the Wewoka IHS Health Center, Wewoka, Oklahoma. These clinics shall be provided at the rate of four (4) per month, sometimes five (5) per month, every Thursday from 8:00 a.m. – 5:00 p.m. REPORTING REQUIREMENTS: The contractor shall submit to the contracting officer’s representative the following item in the quantities stipulated and within time frames identified below: ITEM DESCRIPTIONQUANTITY 1. Monthly invoices shall be submitted on contractor’s stationery and shall reflect signature of duly authorized agent of contractor. Invoices shall include a register of patients treated reflecting the following: name, date of birth, chart number, and date of clinics during which each service was provided. This shall be separate from the invoice. b. Special reports may be requested by the contracting officer during the contract on technical or administrative aspects of contract performance. The contractor shall complete all records, documentation, audits, and reports in compliance with IHS program policies for patient services and medical records. c. Monthly report of services and invoices shall be submitted within the time period stipulated above to Financial Management Branch Office, Oklahoma City Area Indian Health Service attn: Office of Finance and Accounting 701 Market Drive Oklahoma City, Oklahoma 73114 CONTRACTING OFFICER’S REPRESENTATIVE: The contracting officer’s representative representing the Government for the purpose of this contract will be Dr. Ronald Fried, Clinical Director, UPSHS Indian Health Center, P.O. Box 1475, Wewoka, Oklahoma 74884. NON-PERSONAL HEALTH CARE SERVICE CONTRACT: This contract is a non-personal health care service contract as defined in 37.101 under which the contractor is an independent contractor. This professional service of the contractor will be evaluated by the Government via routine IHS staff members review of physicians charts on a quarterly basis or thereafter as appropriate, however, the Government retains no control over the medical professional aspects of service rendered. CLAUSES INCORPORATED BY FULL TEXT: Please note that due to character limitation in FedBizOpps, full text of the Federal Acquisition Regulation (FAR) and Health and Human Services Acquisition Regulations (HHSAR) can be accessed on the Internet at http://www.farsite.hill.af.mil. The provisions of 52.212-1, Instructions to Offerors-Commercial Items (Nov 2007), applies to this acquisition. In addition to the information required in FAR 52.212-1, Contractors shall provide the following: (1) completed “Temporary Waiver of Character Investigation” and “Declaration for Federal Employment” form (2) Dun and Bradstreet Number (note: Contractors must be registered in the Central Contractor Registration to be eligible for award. This can be done at http://www.ccr.gov). The provisions of 52.212-2, Evaluation – Commercial Items (Jan 1999) applies to this acquisition. The Government intends to award one from this solicitation to the responsible offeror(s) whose offer conforming to the solicitation will be the most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes: (1) Price; (2) Qualifications. Both factors are equal in importance. Quotes shall include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications—Commercial Items (Nov 2007) or indicate certifications in ORCA at https://orca@bpn,gov. The clause at FAR 52.212-4, Contract Terms and Conditions—Commercial Items (Oct 2008), applies to this acquisition. EVALUATION CRITERIA Technical as well as price will be a deciding factor for award of a purchase order. The due date for this requirement is March 25, 2009. THE INDIAN HEALTH SERVICE WILL NOT CONSIDER YOUR QUOTE FOR AWARD IF YOU FAIL TO RESPOND TO THESE EVALUATION CRITERIA AS FOLLOWS: A) registration in the Central Contracting Registration (CCR) database (reference www.ccr.gov) B) Propose and provide an all inclusive hourly rate for services. The estimated quantity is 51 eight-hour clinics for a one-year period, with an option to extend for 4-years. The estimated date of award is March 25, 2009. C) Provide a Temporary Waiver of Character Investigation. D) Certifications in ORCA at https://orca@bpn.gov. E) Current license as a SPM in the state of Oklahoma. F) Proof of degree at an accredited College of Podiatry. G) Proof of completed approved residency in Podiatry. H) Proof of current medical insurance in the appropriate amount of $1,000,000 per occurrence and $3,000,000 aggregate.
