- DISA/DITCO, intends to issue a sole source contract to Business Software, Inc., 155 Technology Parkway, Suite 100, Norcross, GA 30092. This acquisition is for maintenance of Business Software TAXFACTORY software covering 1,106,160 employees. The software being maintained is proprietary and protected by copyright laws. No third party maintenance is authorized. Period of performance is 01 Apr 2009 through 31 Mar 2010. The statutory authority for other than full and open competition is 10 USC 2304( c)(1), only one responsible source and no other supplies or services will satisfy agency requirements. Companies who can provide the above listed software maintenance renewal must complete the solicitation, HC1028-09-T-2076 available by email request to jason.day@disa.mil. The resultant contract will be a firm fixed price purchase order. This is a small business set aside. The NAICS code is 511210 for this procurement. The justification detailing the government's essential need for Business Software Taxfactory Software Maintenance is listed below. The following paragraphs, IAW FAR Part 8.405-6(f), are provided to support the limited source justification for proposed orderss exceeding the micro-purchase threshold, but not exceeding the simplified acquisition threshold. DISA Computing Services has a requirement to purchase Business Software TaxFactory Software Maintenance for DISA Mechanicsburg. The Vendor owns all proprietary rights to the software's source code and is the only responsible sole source for maintenance. No other source can provide maintenance upgrades (e.g., versions and releases), correct problems (e.g., patches, fixdocs, Program Temporary Fix (PTF)), and keys/passwords (by CPU model, serial number, or time period) authorizing operation of the software. Based on the above Information, competition is restricted to only one responsible source, Business Software, Inc.
