- LATA/Parallax Portsmouth, LLC (LPP) intends to negotiate sales agreements with one or more parties who expressed an interest in uranium materials offered in RFP08LPP-OFFSPEC-01, FBO #2461, dated August 22, 2008. The lots originally listed are currently open for discussion. LPP intends to use a two part negotiation process to sell the remaining lots. Detailed data and information from the previous solicitation are available on a CD and can be obtained by contacting Dan McKenzie, Contracts Manager, Lata/Parallax Portsmouth, LLC, Phone: 740-897-2438. NEGOTIATION PROCESS: PARTS 1 & 2 PART 1- Parties who showed interest in the August 22, 2008 solicitation and have been contacted by LPP are invited to participate in discussions concerning a purchase or barter transaction for one or more of the remaining lots. In addition, discussions/negotiations are open to parties not currently known; restrictions only apply to those individuals or organizations barred from such transaction by the U.S. Government. Financial and business responsibility, in the context of the terms and conditions of this solicitation, must be demonstrated before award. LPP will negotiate with the interested parties and upon reaching an understanding of the parties’ detailed approach, expected revenue and time frame for performance, LPP will call for a submission of a final sales/purchase contract offer. PART 2 - A schedule for final offers will be established for all interested parties remaining in the competition. LPP will consider for award those offers that yield the greatest value to the government. NOTE: This negotiated sales approach is intended to provide the needed flexibility for purchasers to make innovative offers for the sale and disposition of the off-spec uranium materials. Final Terms and Conditions, including the Model Agreement, for any negotiated sales/purchase contract, may differ from those found in the sales solicitation of August 22, 2008. However, LPP intends to use the substance of the initial solicitation of August 22, 2008, as much as possible, considering the need to accommodate innovative offers. Description REQUEST FOR PROPOSALS (RFP 09 LPP OFF-SPECIFICATION, NON-UF6 URANIUM MATERIALS) SALE AND DISPOSITION OF U. S. DEPARTMENT OF ENERGY OFF-SPECIFICATION, NON-UF6 URANIUM MATERIALS Summary: LATA/Parallax Portsmouth, LLC (“LPP”), a contractor of the U. S. Department of Energy (“DOE” or the “Government”), Portsmouth/Paducah Project Office, Lexington, Kentucky, has a requirement to sell and dispose of DOE’s Off-Specification, Non-UF6 Uranium Materials (the “Uranium Materials”) presently stored at the Portsmouth Gaseous Diffusion Plant (“PORTS”) near Piketon, Ohio. These Uranium Materials are being offered for sale through a two part negotiated sales process. The Uranium Materials offered for sale and disposition are organized into lots. Uranium Materials offered in this solicitation are summarized as follows: Material Type Metric Tons Uranium (MTU) Uranium Metals632 Uranium Oxides990 Uranium Fluorides1511 Uranium Solutions1.453 (11,804 liters) Total 3134 MTU Material Type in Metric Tons Uranium (MTU) Uranium: Metals 632, Uranium Oxides 990, Uranium Fluorides 3134, Uranium Solutions 1.453 (11,804 liters), Total 3134 MTU. LPP reserves the right to accept more than one proposal, or accept a portion of a proposal containing more than one lot, in order to maximize value to the Government. LPP also reserves the right to decline any or all proposals. LPP will select the award(s) based on the overall best value to the Government. All sales are subject to compliance with applicable laws and regulations, including any required determination by the Secretary of Energy that the sale and disposition of some or all of the Uranium Materials will not have an adverse material impact on the domestic uranium mining, conversion or enrichment industry. LPP reserves the right to withdraw any portion of the Uranium Materials offered prior to award and/or schedules to ensure compliance with the Secretary of Energy’s March 11, 2008, Policy Statement on Management of DOE’s Excess Uranium Inventory as implemented by the U.S. Department of Energy’s Excess Uranium Inventory Management Plan, dated December 16, 2008. Authority: The sale and disposition of the Uranium Material is authorized under the Atomic Energy Act of 1954, as amended (42 U.S.C. 2011 et seq.). Access to the site by foreign nationals is difficult to accommodate and an extended amount of time is required to obtain approval. Non-U.S. citizens will not be considered for site visits. LPP will make every effort possible to address questions and requests for information by non-U.S. citizens.
