- THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c) (1), set forth in Federal Acquisition Regulation 6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." The 99th Range Wing located at Nellis AFB, Las Vegas, NV 89191 requires renewal of its Joint Range Extension (JRE) help desk support. The 99th Contracting Squadron intends to make an award to L-3 Communications Titan Corporation of 3033 Science Park Road, San Diego, CA 92121.. Interested parties may e-mail stephen.colton@nellis.af.mil or fax 702-652-5405, Attn: Stephen Colton, not later than Wednesday, 18 February 2009; 4:00 p.m. Pacific Time. Per FAR Part 5.207-13(e) Fed Biz Ops Numbered Note 22 applies and is modified to read: 22. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within seven days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. V. DEMONSTRATION THAT THE CONTRACTORS UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) The Joint Range Extension (JRE) Gateway utilizes a proprietary operating system/software to perform its core functions that are necessary to conduct tactical data link operations on the Nevada Test and Training Range (NTTR). Due to the proprietary nature of the source code of the operating software, L3 Communications, Titan Group, is the only vendor that can provide help desk support and software upgrades for the system. The 98 Range Wing currently employs 7 JRE systems, valued at an estimated $600 thousand on the NTTR. If other sources were used instead of the specified vendor, all of these systems would have to be replaced. The estimated cost to replace the JRE system with a similar system would exceed $1 Million (based on the average cost of like systems). There would be a substantial duplication of cost not expected to be recovered through full and open competition. In addition, there is no other known system that would meet all of the mission requirements of the JRE.
