Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. Solicitation No. DTRT57-09-Q-80031 is issued as a Request for Quotation (RFQ). This solicitation is being conducted under Simplified Acquisition Procedures (SAP), FAR Part 13.5 and FAR Part 12. This solicitation document and incorporated provisions are those in effect through Federal Acquisition Circular (FAC 2005-30). The NAICS Code is 443120 and the Small Business size standard is $8.0M. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The Government intends to award a Firm Fixed-Price Purchase Order on a non-competitive basis in accordance with FAR Part 6.302, to Software AG, Reston, VA, to provide a one year software license renewal. Your proposal shall include pricing for the following items in a written quotation: Contract Line Item (CLIN) 0001- WebMethods one year software license renewal, Contract Number LA 0512-103, quantity: 1 LS $___________; CLIN 0002 ? Software License Renewal, Amendment No. 01, Contract Number LA 0512-103-01, quantity: 1 LS $____________. Solicitation provision FAR 52.212-1, Instruction of Offerors-Commercial Items is hereby incorporated by reference; the offer must include a copy of the standard commercial warranty per FAR Clause 52.212-1(b)(5), Terms of any Express Warranty. All Offerors must include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items (NOV 2006) must be submitted with the offer. FAR Clause 52.212-4, Contract Terms and Conditions- Commercial Items, is hereby incorporated by reference. FAR Clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, is hereby incorporated by reference, additional clauses cited in 52.212-5 that apply to this acquisition are: 1, 15, 16, 17, 18, 19, 20, 21, 23, 24, 28, 29, 36, 38. This notice of intent is not a request for competitive proposals. Offer is due to the U.S. Department of Transportation, Volpe National Transportation Systems Center, Attn: Karen M. Marino, RVP-32, 55 Broadway, Building 1, Room 1148, Cambridge, MA 02142 no later than 2:00 P.M. EST on February 4, 2009. Responses may be sent via email to Karen.Marino@dot.gov or via facsimile to the attention of Karen Marino at 617-494-3649. Interested firms must submit in writing to the identified point of contact, clear and convincing evidence of their qualifications and/or capabilities. Such qualifications and/or capabilities will be used solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. The Government reserves the right to process the procurement on a sole source basis based upon the responses received. The Government will not pay for any information received. ATTENTION: Small and Disadvantaged (SDB), Women-Owned, and Disadvantaged Business Enterprises (DBEs). The Department of Transportation's (DOT) Short-Term Lending Program (STLP) offers working capital financing in the form of lines of credit to finance accounts receivable for transportation-related contracts. The Maximum line of credit is $750,000. The STLP loan has a variable rate, which is connected to the prime rate.
