Description
This is a Request for Information (RFI) announcement for the purpose of seeking resumes from legal professionals who wish to participate in the U.S. Equal Employment Opportunity Commission (EEOC) Administrative Judge Program. Selected participants shall conduct administrative hearings on employment discrimination complaints filed against the EEOC by EEOC employees and applicants for employment under 1) Title VII of the Civil Rights Act of 1964, as amended; 2) the Age Discrimination in Employment Act (ADEA) of 1967, as amended; 3) the Rehabilitation Act of 1973, as amended; 4) the Civil Rights Act of 1991; and 5) the Equal Pay act of 1963, as amended. Additionally, one or more Administrative Judges (AJ) will serve as Neutral Evaluators. Neutral evaluation is a form of alternative dispute resolution (ADR). BASIC REQUIREMENTS. Potential Administrative Judges must possess a law degree from an accredited law school, and be a licensed attorney in good standing in a state, the District of Columbia or Puerto Rico. KNOWLEDGE. Potential Administrative Judges must have a minimum of five (5) years of experience relating to the above statutes, as well as familiarity with federal EEO complaint processing regulations at 29 C.F.R. Part 1614 (November 9, 1999 revision) and federal personnel law. SPECIALIZED KNOWLEDGE. Potential Administrative Judges must have specific training and experience in conducting hearings, or serving as an attorney in judicial or administrative hearings. RESUME. Potential Administrative Judges resumes must document the above requirements and knowledge, and must include the specific numbers and types of employment discrimination cases in which the person was either the adjudicator or the attorney for one for the parties. Potential Administrative Judges must also supply job evaluations for the three (3) years preceding the date of resume, indicating full competence in employment discrimination law and federal personnel law. Additionally, AJ must furnish writing samples, and may include articles, publications or other evidence of standing in the legal profession. SELECTION PROCESS. Qualified AJ’s will be selected for placement on an Expert Source List (ESL), and engaged under a Blanket Purchase Agreement (BPA) to compete for assignments to work on individual cases. Such contracts/purchase orders will be awarded in accordance with federal rules and regulations governing negotiated procurement. Administrative Judges selected must be able and prepared to independently conduct administrative hearings in accordance with EEOC regulations and policies, to write decisions (findings of fact and conclusions of law), and to oversee settlements of complaints. TRAINING. Training will be provided, where necessary, at Government expense to acquaint successful AJ’s with the EEOC administrative practices, and to update and refresh their knowledge of applicable laws and regulations. LOCATION. The EEOC wishes to have successful AJ’s situated throughout the Continental United States. FORMER EMPLOYEES. Former EEOC employees are not eligible for consideration at this time. REMUNERATION. Potential Administrative Judges hired under this program will be paid at the rate of $50.00 per hour plus travel, if any, plus the normal and ordinary expenses incurred in the processing of complaints at the hearing phase. RESUME PARTICULARS. EEOC will accept resumes until April 1, 2009. All expenses of preparing a resume will be borne by the submitter. Administrative Judges must submit two (2) copies of their resume an all other required documents pertaining to this annoucement to EEOC, Anthony R. Price, Contracting Officer, Acquisition Services Division, Office of the Chief Financial Officer, 131 M Street, N.E. Room 4SW20A, Washington, DC, 20507.
