- SPECIFICATIONS APPLICATION OF PESTICIDE AND FERTILIZATION MCNARY LOCK and DAM 1.General. Base Year. This contract period of performance begins March 1, 2009 and shall continue in full force and effect to and including September 30, 2009, unless terminated as otherwise provided in the contract. Option Year(s). This contract is renewable for two (2) additional one (1) year periods, at the option of the Government, by the Contracting Officer giving written notice of renewal to the Contractor not later than 60 calendar days before the contract is to expire. The first option year contract period of performance is March 1, 2010, or date option is exercised, if subsequent thereto, and shall continue in full force and effect to and including September 30, 2010. The second option year period of performance is March 1, 2011, and shall continue in effect until September 30, 2011. The Contractor shall furnish all labor, equipment, chemicals necessary for the application of herbicides and fertilizers to various right-of-way, turf, and non-crop sites on McNary Lock and Dam lands in accordance with the following specifications. NOTE: Mixing of pesticides shall be done only in designated location determined by the Contracting Officers Representative or representative. Pesticides must be stored in a locked exterior cabinet while on Corps of Engineers property. Utility services (electrical power, water services) required in the performance of the contract can be obtained where available from Government sources within the contract areas or from other sources approved by the COR. Applicator must be licensed in Oregon and Washington for the application of pesticides to industrial, right-of-way, turf weeds, and non-crop sites. Contractor must submit proof of licensing prior to award of contract. All applications of pesticides will be applied by boom application, pressure sprayer, 4-wheeled ATV, backpack sprayer, or hand spreader and in accordance with the product label and State, County, and Federal regulations. Applications will be according to manufacturer labels and rates for maximum effectiveness on the target species. Contractor must prevent spillage and inadvertent or over spraying of target areas. Contractors spraying will not interfere with the normal operation of Government activities. Contractor must notify the Natural Resource Manager or his representative prior to each spraying. The contractor must contact the Natural Resource Manager or his representative each day spraying is scheduled, if the weather is questionable, to determine if weather conditions allow spraying. The contractor is required to provide the Natural Resource Manager or his representative with a current product label and Material Safety Data Sheet (MSDS) for all chemicals being used, including surfactants, stickers, and spray indicators. In addition, the contractor must have this information available at all times while working under this contract. Contractor will be responsible for all damages to non-target plants and areas. Contractor will be required to replace or repair damaged plants and structures with equivalent items. Contractor will be required to complete and return a State of Washington (Version 1) Pesticide Application Record for each pesticide being used at the end of each days application. Completed forms will be given to the Natural Resource Manager or his representative or placed in a designated location upon completion of a days application. 2. Inspection and Acceptance. The inspection and acceptance procedures specified herein set forth a general policy that only the services performed by the Contractor in strict accordance with the specifications of this contract will merit payment. The Natural Resource Manager or his representative will implement this policy through spot Government inspection of the services performed and acceptance or rejection of these services. Compliance checks will be made to determine the percentage of coverage of target areas; correct application of pesticides; and amount of over spraying of non-target areas. In cases of unsatisfactory performance, the Government will give the Contractor the opportunity to correct its deficiencies. In cases of continued unsatisfactory performance, the Government reserves the right to stop performance by the Contractor, and have these services performed by other persons or by its own employees. The Contractor will be responsible for all excess costs by the Government in securing such performance, and the Government is authorized to permanently withhold the amounts payable to the Contractor under the contract. Payment will be based on completion of work items including submission of all required paperwork/reports. 3. Pre-Work Conference. Prior to beginning work under this contract, the Contractor must attend a pre-work conference with the Natural Resource Manager or his representative at a time, date, and location established by him. The purpose of this meeting is to review the requirements of this contract and furnish points of emergency contact. 4. Safety. The Contractor and his employees shall comply with all pertinent provisions of the most recent version of The Corps of Engineers Manual EM 385-1-1 entitled Safety and Health Requirements Manual (a copy is available for prospective bidders information and for successful contractors use). The Occupational Safety and Health Act. This contract is subject to the provisions and regulations issued by the U.S. Department of Labor under authority of Public Laws 91-54 and 91-596. Applicable regulations of the U.S. Army Engineer District, Walla Walla, as the storage and handling of materials, equipment, fuels, and supplies will be strictly complied with. All operations will be performed in accordance with accepted safe practices and subject to the inspection and approval of the Natural Resource Manager or his representative and/or the District Safety Engineer. Contractor will be required to wear all personal protection equipment specified in the product label including goggles, face shield, or safety glasses during all mixing operations, application, and handling of the chemical. Also, rubber gloves will be required while handling the chemical and hard hats will worn during all work on Corps of Engineers property directly related to Dam operations or near heavy equipment operation or construction activities. All operations will be in compliance with State and Federal regulations concerning the use and handling of pesticides in the eastern portions of Washington and Oregon The Contractor shall provide Pesticide Application Notice signs and will be responsible for posting and maintaining posted signs according to pesticide labels. These signs measure 4.5 inches x 5 inches and provide space where the Contractor will list the commercial or trade-names of the chemical used, date and time of application, location treated and the Contractor business name and telephone number. The Contractor shall post the signs a minimum of 24 hours before applying chemicals in areas of frequent public use. The Contractor will recommend posting locations for approval by the COR who may require the Contractor to increase or decrease sign numbers or change recommended locations. The Contractor shall supply necessary signposts or other mounting devices and all hardware. Signs will not be fastened to trees. The COR may allow use of some existing signposts. The Contractor shall remove the signs and post only after contamination hazard to the using public in the area treated has diminished to an acceptable level as determined by label information of the product. 5. Pesticide Applications. 1.Bare Ground Applications: To be sprayed no later then March 15th McNary Lock and Dam Dry land: (approximately 75 acres) The contractor must submit a product label to get permission to use any Pesticide from the COR or their representative. Applications will be made using high-pressure system and boom applicator or backpack spray equipment. Areas to be sprayed: " Rock area around main Oregon McNary Lock and Dam entry sign and picnic area/ overlook at Oregon entrance. "McNary lock and Dam gravel shoulders (5 10 feet from asphalt) DeVore Road from hwy 395 to Spillway Park turnaround, Willamette Ave. from intersection with port road to DeVore Road, and 3rd street from DeVore rd to I-82 overpass. "DeVore Road rip-rap embankment road to grass, both sides. "Willamette Ave. overlook parking area 1ft. from edge of pavement and cracks in pavement. "Gravel area at chlorinating building. "Warehouse compound-all gravel areas including under stacked materials and perimeter fence (from fence to grass approx. 10 feet). "Warehouse compound gravel areas adjacent to paved parking lots. "N. and S. Abutments from asphalt to 5 feet below crest on upstream side and down rip-rap far as reachable on downstream side. "N. and S. Abutments gravel road intersections and borders. " Oregon Fish Ladder- gravel roadway between fish ladder and base of dam and 20 feet up rip-rap portion of dam. "Fish pump house dirt area from grass line to concrete and Ice/ Trash sluiceway. "Well houses (well #2 and #3) gravel areas around buildings and along roadways. "Oregon Boat ramp entrance road gravel shoulders, parking areas ( all gravel areas and rip-rap rock from base to road on top of Dam) and gravel areas around the restrooms. "Inside the Electric substations(3). "Outfall ditch area gravel/rock from crest of ditch to grass, road, or fence. "Wildlife nature Area parking areas, road shoulder and gravel areas around restrooms. "West Park gravel areas adjacent to paved parking lots. "West Park baseball fields infield area. "Rock area around Washingtons McNary Lock and Dam entry sign. "Navigation lock, visitor center, and West Park Parking lots (gravel, curb pavements interface, and cracks in pavement). "Washington boat ramp parking areas (gravel- 4). "Navigation lock area Security fence (gravel from pavement to 1ft beyond fence). "Navigation lock Area rip-rap rock areas of N. Abutment from Dam to Washington boat ramp road, from parking area to upstream crest. "Navigation lock area- western access road and parking area. "McNary Beach park entrance road gravel shoulders from county road. "McNary Beach Park gravel areas adjacent to paved parking lots. "Lewis and Clark Hiking Trail (8ft. wide, approx. 4.5 miles). "Warehouse Beach parking areas and gravel areas around restroom. "Sand Station parking areas to within 20 feet and gravel areas around restroom. "Madame Dorion Gravel areas including roads and parking area. 2. McNary Lock and Dam water edges: (approximately 5 acres) The contractor must submit a product label to get permission to use any Pesticide from the COR or their representative. Applications will be made using high-pressure system and boom applicator or backpack spray equipment. "McNary Beach pump jetty to waters edge. "Outfall ditch from waters edge to crest. "Washington boat ramp embankment and road shoulders from pavement to waters edge. "North and South dam abutments water side from crest to maximum distance below crest. 3. Broadleaf Weed Control: (approximately 20 acres per month for 5 months) The contractor must submit a product label to get permission to use any Pesticide from the COR or their representative. Applications will be made using high-pressure system and boom applicator or backpack spray equipment. Spray road edges, lawns, parking areas, trails, and fields for control of broadleaf weeds including; Canada thistle, Russian thistle, kochia, tumble mustard, diffuse knapweed, spikeweed, puncture vine and other broadleaf weeds. Spraying will take place as needed throughout the season from March through September. 4. Lawn Fertilization: (approximately 26 acres) The Contractor will apply a slow release granular lawn fertilizer to areas of the lawn indicated by the COR or their representative in the fall of the year.
