Description
Under the Authority of FAR 6.302-1, its the Government's intent to award a Sole Source to Aligned Management Association, Inc., 793 East Foothill Belevard, Suite A, San Luis, CA 93405 for the purchase of services of planning, coordinating, executing, and providing logisitical support for the Telemedicine & Advanced Technology Center (TATRC)'s during a conference titled, MMVR 2009: NextMed: Design for the Well Being, to be held January 19 - 22, 2009 in Long Beach, CA. Aligned Management Associations Inc., is the established vendor at the conference already. TATRC is a participant therefore, utilizing the the current personnel and contracts already in place. No solicitation document is available and telephone requested will not be honored. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. If no affirmitive written response is received, the purchase will be awarded without further notice. A determination by the Governement not to compete this proposed contract based in this notice is solely within the descretion of the Government. The J & A for Other Then Full and Open Competition is added below. Detailed capabilities, proposal, or quote must be submitted to the following email address no later than 9:00 AM Easten Standard Time, 13 January 2009. Email erin.becker@amedd.army.mil. Below is the J & A for Other than Full and Open Competition for your review: JUSTIFICATION AND APPROVAL TO ACQUIRE USING OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following Justification, the proposed requirement described below may be negotiated without providing for full and open competition pursuant to the authority of 10 USC 2304(c)(1): Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. 1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY: This Justification and Approval for the use of other than full and open competition is undertaken by U.S. Army Medical Research Acquisition Activity in support of requirements for U.S. Army Medical Research & Materiel Commands Telemedicine & Advanced Technology Research Center (TATRC) Ft. Detrick, MD. 2. NATURE AND DESCRIPTION OF ACTION: Pursuant to Federal Acquisition Regulation (FAR) 6.303-1, this is a Justification and Approval covering the award of a firm-fixed price contract for equipment and services on a sole source basis to Aligned Management Association, (AMA) 793-A Foothill Blvd., PMB #119, San Luis Obispo, California, 93405. 3. DESCRIPTION OF SUPPLIES/SERVICES: This Justification and Approval covers the acquisition and services of planning, coordinating, executing, providing limited logistical support and administrative/technical services for TATRCs 9th Annual Technology Exhibit Booth & 1 Day Product Line Review (PLR) on Medical Modeling & Simulation (MM&S), held on Thursday, 22 January 2009, in conjunction with the 17th Annual MMVR conference, 19 22 January, 2009, at the Hyatt Regency Long Beach Hotel in Long Beach CA. The total dollar value of this requirement is $34,980.00. 4. IDENTIFICATION OF STATUTORY AUTHORITY: The statutory authority permitting other than full and open competition is 10 USC 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by Federal Acquisition Regulation (FAR) 6.302-1. The sole source nature of the requirement is in no way due to lack of advance planning on the part of the requiring activity. 5. DEMONSTRATION OF CONTRACTOR'S UNIQUE QUALIFICATIONS: The above acquisition will be negotiated only with Aligned Management Association, (AMA) 793-A Foothill Blvd., PMB #119, San Luis Obispo, California, 93405, in accordance with FAR 6.302-1(b)(2), the existence of limited rights in data... make the services... available from only one source, AMA, is the only source to provide these services, since this is their annual conference which they host, sponsor and convene. They plan, coordinate, and execute this entire event from start to finish, for the duration of the event. 6. CBD ANNOUNCEMENT/POTENTIAL SOURCES: The proposed action is exempt from the requirement to synopsize in the Commerce Business Daily since the proposed contract action is made under similar terms of an existing contract (previously awarded contracts are: 01-P-0212, 02-P-0081, 03-P-0293, 04-P-0098, 05-P-0304, 06-P-0141, 07-P-0144 and 08-P-0189). We will not be issuing a synopsis because the conference is held and sponsored by this company and, therefore, is not required. 7. DETERMINATION OF FAIR AND REASONABLE COST: The U.S. Army Medical Research Acquisition Activity Contracting Officer will determine that the price negotiated for the equipment and services is fair and reasonable pursuant to FAR Part 15. 8. DESCRIPTION OF MARKET RESEARCH: NONE. Aligned Management Association, (AMA) is the designated source and sole possessor of these services, because this is their annual association meeting, which originated with them. This is their conference. They are the only ones who dedicate (3) three days to the field of Medical Modeling and Simulation and Virtual Reality in Medicine. MRMC/TATRC is funding an internal, 1-day Product Line Review (PLR) on Medical Modeling & Simulation (MM&S). 9. ANY OTHER SUPPORTING FACTS: The AMA was named as the co-host at the conclusion of last years conference by the Commanding General and is handling all aspects of registration and logistical support. Other contracts with the AMA that have been executed and relevant are: 01-P-0212, 02-P-0081, 03-P-0293, 04-P-0098, 05-P-0304, 06-P-0141, 07-P-0144, and 08-P-0189. 10. LISTING OF INTERESTED SOURCES: No alternate sources have expressed an interest in this acquisition. See Reasons explained in Para. 5, 8, & 9. 11. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: None due to reasons explained in Para. 9. 12. STATEMENT OF DELIVERY REQUIREMENTS: Delivery will be required in accordance with AMA Inc., best delivery schedule, as mutually agreed upon during negotiations. See attached Statement of Work. 13. TOTAL ESTIMATED DOLLAR VALUE OF THE ACTIONS COVERED BY THIS J&A: The total estimated value of the requirement covered by this J&A is $34,980.00. 14. REFERENCE TO THE APPROVED ACQUISITION PLAN: An acquisition plan is not required for this acquisition in accordance with DFAR 207.103. 15.Technical Certification: I certify that the supporting data under my cognizance, which are included in this J&A, are accurate and complete to the best of my knowledge and belief.
