Description

The U.S. Securities and Exchange Commission (SEC) intends to negotiate on an other than full and open competitive basis with CA Incorporated for maintenance of Universal Elements / eHealth SystemEdge software licenses. CA Incorporated is the only source that has been identified as capable of satisfying the SEC’s requirement. Because of licensing, warranty, and compatibility issues, it is not possible for another source to meet the SEC’s requirement. The statutory authority permitting other than full and open competition is 41 U.S.C. 253 (c) (1), implemented by FAR 6.302-1(a) (2) – Only one responsible source and no other supplies or services will satisfy agency requirements. The SEC intends to award a purchase order to CA Incorporated on or about January 30, 2009. This notice is not a competitive request for proposals. A competitive solicitation will not be issued and no further information will be provided. However, the government will give consideration to interested parties that identify their interest and capability to respond to the requirement or submit proposals by the response date of this notice.
