- Procurement action being conducted under FAR 6.302-1 with the authority of 41 U.S.C. 253 (c), as only one responsible source and no other supplies or services will satisfy the requirement; therefore proposals cannot be submitted directly on this notice. The National Labor Relations Board intends to award a sole-source commercial purchase order to LRP Publications, 747 Dresher Road, POB 980, Horsham, PA 19044 for the following items: Federal Personnel Guide on the Web. LRP Publications is the only known source that can provide the product required. The product would provide uninterrupted, Interet-based database that provides guidance on the most important rules and regulations that affect Federal Government employees' career. It would assist civilian federal and postal employees safeguard their careers and their retirements with accurate, timely summaries of rules and regulations directly affecting their employment. It also covers six full-text CFR titles. This sole source is based the publisher being the only responsible source for providing web access subscription and updates to their own copyrighted material. The National Labor Relations Board (NLRB) intends to negotiate with only one source under the authority of FAR 6.302. This sole source procurement is based on 41 U.S.C. 253 (c) (1) which states that supplies or services required by the agency are available from only one responsible source. Any change would be cost prohibitive. This is a notice of intent to award a sole source procurement action and is not a request for competitive proposals. Firms who wish to challenge the sole-source must submit an interest letter that demonstrates the firm's ability to provide an equivalent service as described above. Interested parties must provide rationale, including pricing, as to why they should be considered. All interested firms must respond by September 30, 2008, 10:00 a.m. Eastern Time to TaLisa Spottswood, via email at talisa.spottswood@nlrb.gov. A determination by the Government not to compete this proposed procurement action based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. NLRB will not reimburse for any costs connected with providing the capability information.
