- FISC Norfolk Detachment Philadelphia intends to acquire 800 hours of Nitric Oxide for inhalation. One unit with starter cylinder and one back-up unit with a regular cylinder. The performance period for this procurement will be 1 Oct 2008 thru 30 Sep 2009 in support of the National Naval Medical Center, Bethesda, MD. The Government intends to solicit and negotiate with only one source under the authority of section 4202 of the Clinger-Cohen Act of 1996, as implemented by FAR 13.501 (a), a Sole Source Acquisition under the authority of the test program for certain commercial items. INO Therapeutics Inc. is currently the only known source providing inhaled nitric oxide approved for human use by the FDA. This procurement is being conducted as a commercial item acquisition in accordance with FAR Part 12, using Subpart 13.5 test program procedures. Award of a firm fixed contract is anticipated. All required deliverables shall be furnished within 30 days after date of cont! ract award. The applicable North American Industry Classification System (NAICS) Code and size standard for this procurement is 621999 and 500 employees respectively. Interested persons may identify their interest and capability to respond to the requirement by sending challenges to David Moore at david.moore8@navy.mil. This notice of intent is not a request for competitive proposals. However, all challenges to this sole source determination received within 3 days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
