Description
The Department of Homeland Security, Customs and Border Protection, Mission Support Acquisition Division, Dallas, Texas is issuing a solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. Solicitation HSBP1008Q2043 is being issued as intent to award sole source to Diamondback Tactical, LLLP, LTD. The quotation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-26. Special Operations Group, which includes the Border Patrol’s National Tactical Team (BORTAC), is responsible for conducting specialized tactical operations within the Border Patrol’s area of responsibility. This includes conducting high risk arrest and search warrant service. At this time, SOG personnel are issued Diamondback Predator Level IIIA tactical body armor and Level III rigid armor plates. After reassessing the threat vs. current protection level, a decision has been made to augment this armor with additional ballistic pieces. These pieces will provide the Agents the enhanced protection needed while operating in these highly dangerous situations. In order to maintain consistency, and facilitate proper fit /function between the original armor and the new accessories, it is necessary to purchase compatible items directly from the same manufacturer. As such, UFPD intends on purchasing 200 (qty) of each item directly from Diamondback Tactical. The statutory authority for use of ‘other than full and open competition’ for this transaction is 41 USC 253(c)(1) as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. The U.S. Customs and Border Protection intend to award a firm-fixed price Contract. CLIN00010, Ballistic Bicep Predator LTA3A, color CYT, item# A-PDBB-LTA3A, Quantity 200 each, CLIN00020, Ballistic Drop Leg Platform LTA3A, color CYT, item# A-BLPF55-LTA3A, Quantity 200 each, CLIN 00030, Groin Protector, color CYT, item# A-PDGRN-LTA3A, Quantity 200 each. FOB Destination to be cited on delivery order. Delivery shall be within 60 days after award of the contract. Inspection and acceptance shall also occur at destination. The provisions at FAR 15.212-1, Instructions to Offerors-Commercial, apply to this acquisition. FAR 12.212-2, Evaluation-Commercial Items, is applicable. Paragraph (a), evaluation criteria are as follows: Award will be made to the most advantageous offer to the Government, price and other factors considered. OFFEROR SHALL INCLUDE A COMPLETED COPY OF THE PROVISIONS AT FAR 52.212-3, Offeror Representations and Certifications-Commercial Items along with the firm’s DUNS number. FAR 52.212-4, Contract terms and Conditions-Commercial Items, applies to this acquisition with the following additional clauses: FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, and the following additional clauses apply to this acquisitions: FAR 52.222-26, Equal Opportunity (E.O. 11246); FAR 52.222-35, Affirmative Actions for Disabled Veterans and Veterans of the Vietnam Era; Affirmative Actions for Handicapped Workers; FAR 52.222-37, Employment Reports on Disabled Veterans and Veterans of the Vietnam Era; FAR 52.216-18, Ordering; and FAR 52.216-19, Order Limitations. FAR Clauses 52.219.1, Small Business Concern Representation, 52.219.14, Limitation on Subcontracting, and 252.219.7009 Section 8(a) Business Development Program are applicable to this acquisition.
