- Description: (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) This solicitation is issued as a Request for Quote (RFQ) against solicitation number FA2550-08-T-1014 for a commercial items acquisition for Wide Format Color Scanner, Installation, Training and Service Plan. (iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-26 effective July 27, 2008. (iv) This acquisition will be 100% Set Aside for Small Business Concerns. The government reserves the right to award to Other Than Small Business Concerns if no quotes are received from Small Business Concerns. The North American Industrial Classification System (NAICS) is: 334119 - Optical readers and scanners manufacturing. The size standard for Small Business Concerns is 1,000 employees. (v) The proposed acquisition consists of the following Contract Line Items Numbers (CLINs): Contract Line Item (CLIN) 0001: Delivery of 1 (each) Wide Format Color Scanner, Colortrac Model GxT42E OR EQUAL. An OR EQUAL brand/model may be accepted if item contains same salient characteristics and performs the same functions. Additionally, scanner shall conform to the following: A. Shall be Windows Vista compatible. B. Shall be controlable from external desktop computers not supplied from dealer or manufacturer (‘plug and play). Shall be capable of scanning board mounted maps. Please see attached specification from Colortrac for additional features. Contract Line Item (CLIN) 0002: Installation. Contractor shall install scanner and applicable (if included) software at time of delivery. Contract Line Item (CLIN) 0003: Training. Contractor shall provide basic functional training at time of installation. Contract Line Item (CLIN) 0004: Service plan to include all materials and on-site labor for period of performance: Upon installment and acceptance by government through 30 September 2009. This requirement option is in accordance with provisions set forth at FAR 52.217-4 and FAR 52.217-5. Please read provision (at xii) below. Contract Line Item (CLIN) 1004: Service plan, Option year 1. Service plan to include all materials and on-site labor for period of performance: 1 October 2009 through 30 September. This requirement option is in accordance with FAR 52.217-4 and FAR 52.217-5. Please read provisions (at xiii) below. (vi) Description of requirements for the items to be acquired. Colortrac Specifications for the item listed above is attached. (vii) Delivery is required not later than 30 calendar days after contract award. FOB Point is Destination: 50th Civil Engineering Squadron (50th CES), 500 O'Malley Ave, Suite 149, Schriever Air Force Base Colorado 80912. (viii) Provision at 52.212-1, Instructions to Offerors - Commercial Items, applies to this solicitation. (ix)Provision at 52.212-2, Evaluation - Commercial Items applies to this solicitation. The specific evaluation criteria included in paragraph (a) of this provision are as follows: (i) technical capability of the item offered to meet the Government requirement; (ii) price; (iii) delivery schedule. Technical capability and delivery schedule, when combined, are approximately equal to price. (x) Provision at 52.212-3 Offeror Representations and Certifications applies to this solicitation. Commercial Items must be completed and provided with this offer or available to the Contracting Office on Online Representations & Certifications Application at https://orca.bpn.gov/. (xi) Provision at 52.211-6 -- Brand Name or Equal (Aug 1999) applies to this solicitation. (a) If an item in this solicitation is identified as "brand name or equal," the purchase description reflects the characteristics and level of quality that will satisfy the Government's needs. The salient physical, functional, or performance characteristics that "equal" products must meet are specified in the solicitation. (b) To be considered for award, offers of "equal" products, including "equal" products of the brand name manufacturer, must- Meet the salient physical, functional, or performance characteristic specified in this solicitation; Clearly identify the item by- (i) Brand name, if any; and (ii) Make or model number; Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and Clearly describe any modification the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modification. (c) The Contracting Officer will evaluate "equal" products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. (d) Unless the offeror clearly indicates in its offer that the product being offered is an "equal" product, the offeror shall provide the brand name product referenced in the solicitation. (End of provision) (xii) Provision at 52.217-4 Evaluation of Options Exercised at Time of Contract Award (Jun 1988) applies to this solicitation. Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate the total price for the basic requirement together with any option(s) exercised at the time of award. (End of Provision) (xiii) Provision at 52.217-5 Evaluation of Options (Jul 1990) applies to this solicitation. Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s). (xv) 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS--COMMERCIAL ITEMS (JUN 2008) (DEVIATION) (a) Comptroller General Examination of Record. The Contractor agrees to comply with the provisions of this paragraph (a) if the contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to the right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times, the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law. (b)(1) Notwithstanding the requirements of any other clause in this contract, the Contractor is not required to flow down any FAR clause, other than those in paragraphs (i) through (vii) of this paragraph in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause--(i) 52.219-8, Utilization of Small Business Concerns (MAY 2004) (15 U.S.C. 637(d)(2) and (3)), in all subcontracts that offer further subcontracting opportunities. (a) The Government may extend the term of this contract by written notice to the Contractor within 15 days provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 2 years. (End of Clause) 52.232-18 Availability of Funds (Apr 1984) Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. (11) AFFARS 5352.242-9000 Contractor access to Air Force installations (AUG 2007) (a) The contractor shall obtain base identification and vehicle passes, if required, for all contractor personnel who make frequent visits to or perform work on the Air Force installation(s) cited in the contract. Contractor personnel are required to wear or prominently display installation identification badges or contractor-furnished, contractor identification badges while visiting or performing work on the installation. (b) The contractor shall submit a written request on company letterhead to the contracting officer listing the following: contract number, location of work site, start and stop dates, and names of employees and subcontractor employees needing access to the base. The letter will also specify the individual(s) authorized to sign for a request for base identification credentials or vehicle passes. The contracting officer will endorse the request and forward it to the issuing base pass and registration office or security police for processing. When reporting to the registration office, the authorized contractor individual(s) should provide a valid driver's license, current vehicle registration, and valid vehicle insurance certificate, to obtain a vehicle pass. (c) During performance of the contract, the contractor shall be responsible for obtaining required identification for newly assigned personnel and for prompt return of credentials and vehicle passes for any employee who no longer requires access to the work site. (d) When work under this contract requires unescorted entry to controlled or restricted areas, the contractor shall comply with AFI 31-101, Volume 1, The Air Force Installation Security Program, and AFI 31-501, Personnel Security Program Management as applicable. (e) Upon completion or termination of the contract or expiration of the identification passes, the prime contractor shall ensure that all base identification passes issued to employees and subcontractor employees are returned to the issuing office. (f) Failure to comply with these requirements may result in withholding of final payment. (xviii) Defense Priorities and Allocations System (DPAS) and assigned rating will not apply. (xix) Attachment titled, "Hold Harmless Agreement", shall be signed, dated and submitted with quote.
