Description
NOTICE THIS IS NOT A REQUEST FOR QUOTATION/REQUEST FOR PROPOSAL, but instead is a notice of intent to award a Sole Source Contract. The Export-Import Bank of the United States intends to award a sole-source contract to Global Recovery Group (GRG) in order to provide continued support for international claim recovery services. By the authority of 41 U.S.C. 253 (c)(1) and in accordance with FAR 6.302-1(a)(2), this action is approved for international claim recovery services from Global Recovery Group, LLC (“GRG”) for a period of five years. (Base plus four (4) options) The Export-Import Bank of the United States (“Ex-Im Bank”) requires specialized international (world-wide) recovery services to support its collection efforts as identified in the Scope of Work. This Contract will provide for services related ONLY to work currently assigned to GRG as of 12/31/08. No new work will be added after that date. All new work will be the subject of a separate competition. A separate requirement will be competed using GSA schedule procedures at FAR Part 8. That requirement is for new collection cases and will involve a base year and four option years. The GSA schedule RFQ is anticipated to be released on 10/31/08 with performance to begin Jan 1, 2009. GRG has been performing on a recovery contract since February 2004. In the course of these efforts GRG has initiated restructuring agreements and litigation in an attempt to maximize the net recovery to the taxpayer. Ex-Im Bank believes that it is critical to the ultimate recovery to have continuity in these recovery efforts. This sole source contract would be effective only for cases which are assigned to GRG as of December 31, 2008. No additional cases would be added to this effort. GRG is uniquely qualified to perform the services needed, as stated in the Statement of Work, because of the knowledge that it has gained of these credits. In performing these services over a period of several years, GRG has become familiar with the subject companies, guarantors, assets, and legal issues involved with the cases. GRG is the ONLY firm that would have this knowledge. GRG has developed relevant contacts and relationships with debtors, guarantors, and attorneys that cannot be replicated within a timeframe that would not adversely affect the final recovery on these cases. In view of the fact that the recoveries through established repayment plans and ongoing court cases would be maximized through the continued efforts of GRG, a continuation of these efforts is essential. Time is a critical factor in the collection of insolvent and unsecured credits because the financial condition tends to deteriorate over time. Replacing GRG would result in a protracted delay in the collection and legal efforts and would therefore reduce the ultimate recovery that Ex-Im Bank would expect to receive on behalf of the taxpayer. This announcement constitutes the sole source notice. A copy of the written Statement of Work (SOW) may be requested from the Contracting Officer as stated below. The Contract will be a base year and four (4) option years. The Period of Performance is January 1, 2009 through December 31, 2009. This is a SOLE SOURCE REQUIREMENT. Contractor shall provide all labor, collection expenses, materials, equipment and facilities to provide the Export-Import Bank with assistance in recovering balances of certain paid claims against the Bank’s credit guarantee and insurance programs.
