Description
Department of Veterans Affairs, VA Boston Healthcare System, MA--Intent to sole source procurement under FAR 6.302-1, only one responsible source with Advance Sterilization Products for the following items (brand name or equal): The VA Boston Healthcare System, West Roxbury and Jamaica Plain Campuses, has a requirement for a full service on-site maintenance contract Plasma Gas sterilizers used for the sterilization of surgical instruments. Contractor shall furnish all parts, labor, equipment, materials, travel, and transportation to perform all scheduled and unscheduled maintenance for the equipment listed below. Period of performance 10/01/2008-09/30/2008 plus four option years. 1.Sterilization Unit Plasma, Model Sterrad 100S Serial# 57996011 VA PM# 86020 Location: AB7-02-WR 2.Sterilization Unit Plasma, Model Sterrad NX Serial# 10033060668 VA PM# 89603 Location: AB3A-02-WR 3.Sterilization Unit Plasma, Model Sterrad 200 Serial# 10200060664 VA PM# 90228 Location: 2D74-1-JP 4.Sterilization Unit Plasma, Model Sterrad NX Serial# 10033060669 VA PM# 89602 Location: 2D74-1-JP 1. CONTRACTOR REQUIREMENTS: Contractor will provide only technically qualified technicians who are formally trained on the above equipment. Service personnel must have a good working knowledge of the equipment. Contractor provides a plan for service coverage if less than two (2) personnel are trained on the equipment. The plan describes and ensures the Government is not without service support for more than one day. Contractor shall obtain the most current legal editions of the original equipment manufacturer (OEM) literature or approved copies. Contractor shall furnish and install only OEM repair parts and OEM recommended substitution/ modifications, as required ensuring proper and safe operation of the equipment. Contractor shall have knowledge of, furnish and install all OEM sponsored modifications at no additional charge. This includes all the OEM published Equipment Changed Orders (ECO) and Fielded Change Orders (FCO). Mandatory modifications include equipment upgrades or enhancements to equipment design, and changes necessary for operator and patient safety. Manufacturer sponsored modifications are made as hardware/software updates/ corrections becoming available from the manufacturer. In addition, the Government may request the Contractor to install said OEM sponsored modification in the event that the Government obtained knowledge of ECO or FCO before the contractor. Contractor will make all ECO and FCO modifications in a timely manner, but in no case shall it exceed sixty (60) calendar days after ECO or FCO is announced by the OEM. All such modifications shall be made so as not to interfere with the Government's operation. If such modification is not possible during normal duty hours, the Contractor will do the modifications outside of normal duty hours (overtime) at no additional cost the Government If the Contractor is unable to repair the unit and subcontracts out to a third party, the Contractor will not stop the third party in the middle of the repair job and will not charge the Government for the subcontracted labor. Contractor must submit all requested certifications and licenses and pass background investigation. Sole source Justification provided to contracting: JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of the agency and the contracting activity. VA Medical Center, Engineering Service, Jamaica Plain, MA *2. Nature and/or description of the action being approved. Provide full service and maintenance for Sterad plasma gas sterilization systems. *3. Description of the supplies or services required to meet the agency's needs (including the estimated value). - 523-09-1-4810-0017 4. Identification of the statutory authority permitting other than full and open competition. FAR 6.302-1, USC 253(c)(1) Only One Responsible Source *5. Demonstration that the proposed contractor's unique qualifi- cations or the nature of the acquisition requires use of the authority sited. Service attempted or performed by any person not authorized to do so by ASP will void any warranty on the system. In addition, there are proprietary parts that are necessary to service a STERRAD system. These parts are only available to ASP authorized engineers. *6. Description of efforts made to ensure that offers are Solicited from as many potential sources as is practicable, including whether a Commerce Business Daily notice was or will be published. None the manufacture of this product is the only one that can provide parts necessary to repair this system. This is a proprietary system. 7. Description of the market survey conducted (i.e., names, of firms and the date(s) the firms were contacted) and the results or a statement of the reasons a market survey was not conducted. Any other facts supporting the use of other than full and open competition, such as an explanation why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. N/A CERTIFICATION I hereby certify that the data provided herein is complete and accurate to support other than full and open competition. DAN WILLIS ____________________________________________7/24/08 SIGNATURE OF APPROVING OFFICIAL DATE FOR REQUESTING SERVICE The government has determined that only one manufacturer can satisfy the agency's requirement and intends to negotiate with only one source. This notice of intent is not a request for competitive quotes. No solicitation is available and telephone requests will not be accepted. However any manufacturer that determines it can meet the requirements may give written notice through e:mail to Contract Specialist, Kimberly Perkins. at kimberly.perkins3@med.va.gov by close of business August 4, 2008. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to provide the above requirements at no cost or obligation to the government. All responses received will be evaluated by the government, however the information received will be considered solely for the purpose of determining whether to conduct a competitive procurement solely at the discretion of the government. If no responses are received the VA Boston Healthcare System will precede to sole source this requirement to Advance Sterilization Products.
