Description
THIS SYNOPSIS IS FOR A SOLICITATION TO BE ISSUED PURSUANT TO FAR PART12 - ACQUISITION OF COMMERCIAL ITEMS. The Department of Energy (DOE) Office of Science Chicago Office (SC-CH) Intellectual Property Law Division (IPL) seeks to acquire patent preparation and prosecution services that will involve: (1) preparation of patent applications from invention disclosures; (2) the prosecution of patent applications including the preparation of amendments, briefs, interference papers, requests, notices and other papers as well as interviews with Patent Examiners that may involve travel, as may be required from time to time during the period of this contract; and/or (3) preparation of foreign patent applications and prosecution thereof. SC-CH IPL is responsible for providing intellectual property support and counsel to SC-CH, DOE Headquarters, and other DOE organizations and projects. IPL manages and monitors invention disclosures to ensure timely election of title, filing of patent applications and accounts for bars to patentability and value to DOE. In addition, IPL prepares, files and prosecutes patent applications before the U.S. and foreign patent offices on behalf of DOE to include conducting appeals and assisting in interference proceedings. Knowledge and experience in patent preparation and prosecution in the following fields is required. The fields of art/technology listed below are in descending order of importance to DOE: (i) Nuclear energy (ii) Fuel cells (iii) Radioactive waste storage and remediation (iv) Fossil fuels technology (v) Nanotechnology (vi) Biotechnology (vii) Materials science technology (viii) Nuclear, Chemical, Biological detection systems (ix) Renewable energy technology (x) Electro-mechanical devices This acquisition is set-aside for eligible small business firms. The North American Industry Classification Code is 541110 and the small business size limit standard is $6.5 million. It is the Governments intent to award multiple contracts for the patent preparation and prosecution support services to two or more small business concerns under this Request For Proposal (RFP). However, the Government reserves the right to award only one contract if, after evaluation of offers, it is determined that only one Offeror is capable of providing the services at the level of quality and performance required. Time and Materials type contract(s) using a fully burdened fixed Direct Productive Labor Hour (DPLH) rate with task order assignments is contemplated under this RFP. The proposed period of performance for the contract(s) is expected to be a base period of one year and four one-year option periods, for a total performance period of five years. Annual estimated DPLHs are 350, which would be divided between the successful Offerors if multiple awards are made. The place of performance will be at the facility/office of the successful Offeror(s).
