- This Amendment A001 to the Solicitation DTRT57-08-R-20028 is effective June 12, 2008. This Amendment A001 is issued to replace the contents of the Combined Synopsis/Solicitation DTRT57-08-R-20028 issued on June 10, 2008 in their entirety with the following: The U.S. Department of Transportation, Research and Innovation Technology Adminstration, John a Volpe National Transportation Systems Center (Volpe Center) intends to award a contract, based on a sole source procurement, to Progressive Software Solutions, Inc. (D.B.A. Promergent and Prosoft) of East Syracuse, NY in accordance with FAR 6.302-1, only one responsible source, and no other type of supplies or services will satisfy agency requirements. The Volpe Center intends to procure, through a Firm-Fixed-Price contract, maintenance and support of Eden Architecture software, including Eden Application Development and Deployment Framework software and Eden X-Stream software, deployed at the Federal Aviation Administration (FAA). This combined synopsis/solicitation for commercial items is prepared in accordance with the format in Federal Acquisition Regulation (FAR) Part 12, Subpart 12.6, as supplemented with additional information included in this notice. The Contracting Officer is utilizing policies and procedures prescribed in FAR Part 12, Acquisition of Commercial Items; FAR Part 13.5, Test Program for Certain Commercial Items; and FAR Part 15, Contracting by Negotiation. The clauses and provisions incorporated in this document are those in effect through Federal Acquisition Circular 2005-25 effective April 22, 2008. The NAICS Code is 541511, Custom Computer Programming Services, and the Small Business size standard is $23 Million. STATEMENT OF WORK (SOW)---(BEGIN) [1.0 Background.] The Volpe Center, in Support of its Federal Aviation Administration (FAA) customer, has undertaken program management and support contracting for the FAA WebCM system. The following WebCM-related services are being supplied under separate contract between the Volpe Center and Promergent: WebCM Custom Software Development, Help Desk, System Test of Custom Software Developed, Enterprise Training Activities, General Program Management Support, and Engineering Support Activities. The purpose of this Statement of Work (SOW) is to acquire the annual the software maintenance agreement for Eden Architecture that provides support in the form of Error Corrections, Software Updates, and Technical Support (via Internet, phone, email, and facsimile). [2.0 Task 1: The contractor shall deliver Eden software maintenance, error corrections, software updates, and technical support for the Eden Architecture software, including Eden Application Development and Deployment Framework software and Eden X-Stream deployed by the Federal Aviation Administration (FAA). The number of users being supported is 4,000 concurrent users.The Contractor will provide Help Desk support related to Eden Error Corrections, Software Updates. This Help Desk support will be available during Normal Business Hours Monday through Friday from 8:00AM to 5:00PM EST. Under this Eden software maintenance contract, the Government will receive all bug fixes and major releases of the Eden Architecture software. Eden Help Desk support and technical support will be provided by the Contractor via cell phone or landline telephone, e-mail, and remote access. Contractor will run a development server located at its headquarters. The development server and the testing server are used for Eden development, maintenance, Eden Help Desk, and testing prior to release into the FAA environment. The contactor is entitled to both physical and logical access at all FAA sites where Eden is deployed. Electronic access is maintained by a T1 line and the FAA Intranet. The FAA shall provide account access and facilitate the contactors access to servers and data as needed [3.0 Technical Environment.] The contractor will provide Eden software maintenance support at three sites around the country: the Primary Server site, the Back-up server site, and the Application development server site. The location of the servers is subject to change. A description of the server hardware/firmware and server locations will be provided by the Government upon contract Award. [4.0 Deliverables and Delivery Timeframe.] Contractor will deliver the following: (a) Most Current Production Version of Eden Architecture software for the FAA WebCM software application, delivered in electronic copyrighted format (on CD ROM or other commercially available media) for disaster recovery purposes---Delivery within 7 days of Contract Award Date. (b) Latest Release of Eden Architecture software---Delivery to production server within 180 days after Contract Award. [5.0 Period of Performance (POP).] The POP will be from the effective date of the Contract until February 28, 2009. [6.0 Contract Management.] (a) Monthly Incident Reports and Electronic Records. The Contractor is required to deliver a Monthly Incident Reports to the Volpe COTR within 15 days, following the end of each month. Report will include at least the following: time and name of initiator, date/time of incident, date/time reported, incident description, description of resolution, name of engineer resolving etc. An up-to-date electronic database of incidence records will be delivered monthly. STATEMENT OF WORK (SOW)---(END) PROPOSAL PRICING: The Contractor shall provide the necessary personnel, services, equipment and materials to perform the Contract Line Item Number (CLIN) 0001 in accordance with the above SOW. Proposals shall include unit pricing per month and extended pricing for a Period of 9 months for the following CLIN: CLIN 0001: Software Maintenance-Services (in accordance with SOW) $___________/month and $____________/9-Month Period. INSTRUCTIONS TO OFFERORS: All responsible sources may submit a capability statement or a proposal, which shall be considered by the agency. A determination not to compete this proposed contract based upon responses to this combined synopsis/solicitation is solely within the discretion of the Government. The Government does not anticipate holding discussions after receipt of offers and advises all Offerors to present their best prices in response to this solicitation. The Offeror's failure to comply with the solicitation instructions may render its proposal to be non-responsive. Offerors shall comply with FAR 52.212-1, Instructions to Offerors-Commercial Items. Addenda are as follows: (a) Submission of offers (1) The offer must be marked with Solicitation Number DTRT57-08-R-20028. (2) The time for receipt of offers is 12:00PM Eastern Time on 06/18/08. The signed offer must be submitted electronically, as a pdf file, via email to Lisa.Bucci@volpe.dot.gov. The offer should be addressed to Ms. Lisa Bucci, Contract Specialist, U.S. Department of Transportation, Volpe National Transportation Systems Center, Acquisition Division, RTV-6D2, 55 Broadway, Cambridge, MA 02142-1093. Submission by facsimile machine, by mail, or in any non-pdf file format is not authorized. (3) In addition to the name, address, and telephone number of the Offeror, an email address is required. (b) Period for acceptance of offers is 60 days. EVALUATION OF OFFERS: Price, technical capability, and past performance are approximately equal factors in the evaluation of offers. Offeror's careful compliance with FAR 52.212-1 (b)(4) and (10) will permit the Government to evaluate technical capability and past performance. The Technical proposal should include a full description of the Offeror's approach to the work including a Quality Control Plan and Service Level Agreement matrix that provides a description of events that can occur, priority categorization and urgencies, guaranteed response times, and resolution time. In the technical proposal, Offerors shall also provide names and resumes of Key Personnel for the service being provided. Offerors shall submit their past performance information as a separate part of their Technical proposal for both the Offeror and major proposed subcontractors (over 20% of the unit pricing for any CLIN). Past performance information will be used both for responsibility determinations and as an evaluation factor. The Offeror must provide a list of three contracts that it is currently performing or has completed within the past three years and that the Contractor considers the most relevant in demonstrating its ability to perform the proposed effort. Include the following for each contract: Contracting Officer's Name, Contracting Officer's Agency/Firm and Address, Contracting Officer's Telephone Number, Contract Number, Description of the Work performed under the contract, Task Order Number, Period of Performance, and Total Contract Value. The Offeror will be given an opportunity to respond to any negative past performance information received. If no response is received within the specified timeframe, the negative past performance information will be evaluated as submitted. If the Offeror has no relevant past performance history, it must affirmatively so state. If the Offeror does not include past performance history or does not affirmatively state that no past performance history exists or can be obtained, the proposal will be rated Unacceptable. PROVISIONS AND CLAUSES: The clauses FAR 52.212-3 Offeror Representations and Certifications-Commercial Items and FAR 52.212-4 Contract Terms and Conditions-Commercial Items are incorporated by reference (IBR) into the solicitation and the resulting contract.
