- The Department of Energy (DOE), Environmental Management ConsolidatedBusiness Center (EMCBC) Office of Contracting, intends to issue a sole source modification to extend the period of performance under commercial contract DE-AM24-98OH20053 with Energy Solutions (formerly Envirocare of Utah) to provide services to dispose of the Departments Class A Low Level Waste (LLW) as defined in 10 CFR 61.55 found at: http://www.nrc.gov/reading-rm/doc-collections/cfr/part061/part061-0055.html. The current period of performance ends June 29, 2008. The base period required and for which the contract will be extended ends June 29, 2011 with an additional option to extend to June 29, 2013. The contract extension is estimated to dispose of up to 150,000 cubic yards of radioactive soil and debris (June 30, 2008 to June 29, 2011) or a total of up to 180,000 cubic yards including the additional option period (June 30, 2011 to June 29, 2013). Consistent with the continued services required, the extension period is necessary to perform Licensed Class A LLW Disposal. These services include, but are not limited to the following: Work associated with receipt and licensed disposal of radioactive wastes o Waste Characterization o Transportation Support (handling transporting vehicles/railcars) o Disposal of radioactive wastes (soil and debris) o Release of Vehicles (cleaning/decontamination of vehicles/railcars) Reporting Requirements o Waste acceptance/disposal documents (receiving and acceptance) o Reports (summary of volumes disposed of, audits, and license) The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under authority of FAR 6.302. The statutory authority permitting other than full and open competition is Section 303(c) of the Federal Property and Administrative Services Act of 1949, as amended by the Competition in Contracting Act (41 U.S.C. 253(c)(1)), implemented under Federal Acquisition Regulation (FAR) 6.302-1(a) which authorizes other than full and open competition when the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy agency requirements. The present contract with Energy Solutions is due to expire on June 29, 2008. The contract extension will include the services needed to dispose of LLW at the contractors disposal facility and final cleaning of transportation vessels (truck, railcar, shipping container) for return of the vessel to the owner in compliance with all applicable laws and regulations and DOE policy. Continuation of disposal services through June 29, 2011 with an option to extend until June 29, 2013 will facilitate the proper disposal of radioactive waste currently planned for removal from DOE sites around the United States. The planned cleanup efforts are in support of the Department of Energy and its Office of Environmental Management. THIS IS NOT A FORMAL REQUEST FOR PROPOSALS UNDER FAR PART 12, 15, OR AN INVITATION FOR BIDS UNDER FAR PART 14. IF PARTIES CHOOSE TO RESPOND, ANY COST ASSOCIATED WITH THE PREPARATION AND SUBMISSION OF DATA OR ANY OTHER COSTS INCURRED IN RESPONSE TO THIS ANNOUNCEMENT ARE THE SOLE RESPONSIBILITY OF THE RESPONDENT AND WILL NOT BE REIMBURSED BY THE GOVERNMENT. Interested parties believing they have all of the capabilities, including compliance with licensing requirements, may submit capability statements to provide all of the services, including a demonstration of the ability to meet all of the needs identified above within the required timeframes.
