Description
Amendment #4 to Solicitation VA-260-08-RP-0170 1) INSTRUCTIONS, CONDITIONS AND OTHER STATEMENTS TO BIDDERS/OFFERORS, section (a.5) is changed read as follows: Offerors shall submit their proposals and scanned copies of their Bid Guarantee Bonds electronically by 12:00 PM, 29 May, 2008 to Erik.Berg@va.gov. Original Bid Guarantee Bonds shall be sent to the address listed in Block 7. 2) Specifications Section 01010 General Requirements, 1.2.B.2 Deductive Bid Item #2 is deleated. 3) Solicitation Questions: 3.1 Question - The price of fuel is extremely volatile and can change as much as 30 to 40 % daily. ANSWER - Change the current deductive bid item #2. Do not put anything in the bid concerning refilling the new above ground tanks. The VA will transfer the current fuel to the new tanks, so no new fuel is necessary. 3.2 Question - Please clarify your request for double walled piping. From all suction lines, fill lines either to equipment or to the boiler room walls. ANSWER - Double containment is required on piping outside of the building for the new above ground tanks. 3.3 Question - How often (number of lifts) will certified compaction testing be required (if at all)? ANSWER- Certified compaction testing will be required at least every five feet. 3.4 Question - Will the attached submittal be acceptable per pre-bid approval as noted in the subject section? (City of Medford approved aggregates, Field worksheet for aggregate,maximum density of construction materials), ANSWER - The use of " " minus is acceptable. 3.5 Question - What is the rebar specification for the ballast in each UHOT pit? ANSWER - Drawings are not available for all four tanks, but as a reference, there is approximately 6 to 12 depth of concrete with a 6" x 6" mesh rebar type concrete slab under the tanks, and attached to the tanks with "J" hooks. 3.6 Question - Will an outside area be available for final storage? Will this material be handled according to section 02200 Part 3.5 B ? Will the VA consider using the clean material for backfill? ANSWER - Yes. Yes. Yes. 3.7 Question - Questions regarding the engineered backfill of the eastern most tank pit. The east side pit wall next to the transformers will be approximately 5.5 feet from the transformer to the north, the pit depth will be a minimum of 17 feet, because of the transformers location the east wall cannot be sloped at 2 to 1 as needed therefore my question is would open graded rock such as non-compacted pea gravel be acceptable as fill for all or any portion of this pit in lieu shoring on the east wall? Also can any or all of the trees on the northwest side of the pit be removed? ANSWER - Due to the location of the transformer, some sort of shoring would be prudent. Trees will not be removed unless absolutely necessary. 3.8 Question - Per numbered sheet note 3 on drawing B-2. Will the VA approve the use of clean excavated soils for backfill? If not, will the VA approve unit pricing for any fill required exceeding the volume required for the removed UHOT's. ANSWER - Soils verified clean by HOT contractor can be used as backfill. 3.9 Question - Will there be a requirement for submittals to be forwarded to OR-DEQ? Or will submittals be forwarded to the VA according to OR-DEQ criteria? Excerpts of the specification suggest parts of the OR-DEQ-UST decommissioning regulations and those for leaking underground storage tanks instead of regulations regarding HOT's. Will the VA accept decommissioning and sampling practices for HOT's as approved and regulated by OR-DEQ if they differ from the specification? ANSWER - The VA has HOT's not UST's, and the applicable regulations should be followed. 3.10 Question - What is the age of the existing fuel oil and /or when were the last fuel drops? ANSWER - As much of the fuel that can be; will be used in the boiler room before the tanks are removed. 3.11 Question - Does the VA have access to a geotech report? Does the VA have any geologic information regarding the entire site in order to determine if sloped sides would be possible for excavation on slab without construction of full pit shoring? What is the actual distance from the edge of the electrical trench to the edge of the ballast slab? What is the voltage of all lines to and from transformers and conduits? ANSWER - The only geologic information available is in the February 2007 Subsurface Soil and Groundwater investigation report which will be available. The actual distance is not known, and will have to be determined by the contractor. There are high and low voltages from the transformers and conduits. 3.12 Question - Request for extension for the solicitation. ANSWER - Mr. Berg has answered this. 3.13 Question - Can a copy of the report referenced in the specs, Subsurface soil and groundwater investigation conducted in 2007? ANSWER - The 2007 report will be provided as reference material only. Site conditions may have changed since the report was finished. 3.14 Question - If groundwater investigation has been conducted, what is the ground water flow or recharge rates? It is impossible to quantify the dewatering activity without this information. ANSWER - The only geologic information available is in the February 2007 Subsurface Soil and Groundwater investigation report which will be available as reference material only. Site conditions may have changed since the report was finished.. 3.15 Question PPI - If soil samples have been taken to determine contaminants type and amount, has the limits of the contaminants been accurately identified both in area and in depth? It is impossible to quantify the soil remediation activity with this information. ANSWER - The 2007 report is available, and to be used as reference only. The contractor will have to verify the current site conditions during excavation. 3.16 Question - It is expected that the excavation, demolition, and removal of soils will harm the existing trees in the tank removal area. Is it acceptable to remove the trees? ANSWER - Only if absolutely necessary, will the trees be removed. 3.17 Question - The new tank pad design does not provide for spill containment. Please explain how the spill containment is to be addressed in the design. ANSWER - The tank is double walled. 3.18 Question - Is the depth of contaminated soils known? ANSWER - The 2007 report is available, and to be used as reference only. The contractor will have to verify the current site conditions during excavation. 3.19 Question - Is the depth of groundwater known? ANSWER - The 2007 report is available, and to be used as reference only. The contractor will have to verify the current site conditions during excavation. 3.20 Question - Please advise if a sealer is required on the new tank pad. ANSWER - VA specifications don't require the use of a sealer in this instance. 3.21 Question - Is it acceptable to core drill and set fence post in grout? ANSWER - Core drilling to set the post, and backfilling the post with concrete is acceptable. 3.5 Question PPI #22 - What is the depth of the fuel line, gas line, tank utility lines, electrical service conduits in the limits of construction? ANSWER - The exact depths are not known, the contractor will have to locate. 3.23 Question- Structural soil fills are specified for fill under new tank pads, will rock fills also be required? ANSWER - Crushed stone or gravel as per 02200. 3.24 Question- Granular fills are specified in 02200 earthwork as crushed stone or gravel, what depth is required for this layer? ANSWER - Minimum 6" 3.25 Question- Clarify what permits are required by the contractor for this project. Clarity what permits are provided by the VA. ANSWER - No permits will be provided by the VA. The contractor will provide all permits required. 3.26 Question - Who is the point of contact in the event the large electrical transformers set over contaminated soils and need to be moved? ANSWER - Andy Briones or David Schellinger. 3.27 Question - Is the existing manhole cover at the new tank location needed for access in the future? Should it be moved to a new location out from under the tank? ANSWER - Utilizing tank saddles, the minimum required height of the tank bottom is 12" above concrete. Given the position of the manhole cover, it appears that the lid will still be accessible. The actual dimensions should be verified by the contractor prior to construction. 3.28 Question - Who is required to be HOT certified? Is the environmental engineering firm who is supervising the excavator? Or do both need to be certified? ANSWER - Those that will be on site supervising the excavation of the old tanks and the any excavation necessary for the new tank pad will have to be HOT certified. 3.29 Question- Who's call on the new AST? Gov, local, or state fire marshal? ANSWER - The state fire marshal, which will require an application and plan submittal. 3.30 Question- What is the procedure and material that will be acceptable for the aboveground fuel containment piping? ANSWER - Please refer to section 15606-15, paragraph 2.8 of the specifications for project 692-06-103, which states the contractor is fully responsible for the design of the piping secondary containment system. 3.31 Question- How are the connections to the tank to be contained? ANSWER - Please refer to section 15606 - 15, paragraph 2.8 of the specifications for project 692-06-103, which states the contractor is fully responsible for the design of the piping secondary containment system. 3.32 Question- How are the valves to be contained? ANSWER - Please refer to section 15606 - 15, paragraph 2.8 of the specifications for project 692-06-103, which states the contractor is fully responsible for the design of the piping secondary containment system. 3.33 Question - How is the FQMS to be contained and its valves? ANSWER - Please refer to section 15606 - 15, paragraph 2.8 of the specifications for project 692-06-103, which states the contractor is fully responsible for the design of the piping secondary containment system. 3.34 Question - How are the unions to be contained? ANSWER - Please refer to section 15606 - 15, paragraph 2.8 of the specifications for project 692-06-103, which states the contractor is fully responsible for the design of the piping secondary containment system. 3.35 Question - How is the ultra-violet ray exposure to be monitored on the containment pipe? ANSWER - Please refer to section 15606 - 15, paragraph 2.8 of the specifications for project 692-06-103, which states the contractor is fully responsible for the design of the piping secondary containment system. 3.36 Question - How is the internal condensation between the product and containment piping to be monitored and expelled? ANSWER - Please refer to section 15606 - 15, paragraph 2.8 of the specifications for project 692-06-103, which states the contractor is fully responsible for the design of the piping secondary containment system. 3.37 Question - Will this installation require an engineering design with stamp or is an industry standard installation from a specialized containment piping vendor acceptable? ANSWER - Please refer to section 15606 - 15, paragraph 2.8 of the specifications for project 692-06-103, which states the contractor is fully responsible for the design of the piping secondary containment system, which will be submitted to the VA for approval. 3.38 Question - Please explain how the changeover piping and pump replacement can occur without having an interruption of fuel oil to the boilers? ANSWER - The boiler room currently operates on natural gas. Any time the boiler room normal operations will have to be interrupted will have to be thoroughly coordinated with the VA. 3.39 Question - I am not an electrician or the equipment supplier, but how is the FQMS going to be protected from the exposure of the climate conditions? ANSWER - Please refer to section 15606 - 15, paragraph 2.6, subsection D, states, NEMA 3A or better. 3.40 Question - Are the detailed pipe supports acceptable as shown or is an engineer required to provided calculations and stamp? ANSWER - Please refer to note 13 on page 9 of 16 of the drawings for project 692-06-103. 3.41 Question - Is a copy of a sub surface site investigation report available for the areas of the tanks? ANSWER - The only geologic information available is in the February 2007 Subsurface Soil and Groundwater investigation report which will be available. 3.42 Question - Is a copy of a report available that indicates what the groundwater elevations are around the tanks? ANSWER - The only geologic information available is in the February 2007 Subsurface Soil and Groundwater investigation report which will be available 3.43 Question - Is it possible to change the unit rate for excavation, handling and disposal of the impacted solid to per ton? This material will be weighed on certified scales at the disposal facility providing a more accurate and less expensive way to handle the measurement and payment. ANSWER - Provided all contractors use the same unit, we take no exception. 3.44 Question - It appears the new AST system is located directly on top of the existing sewer manhole. Is an as built drawing available for the existing sewer line showing how the utility line runs where manhole is located in relation to the proposed AST pad? What is the plan for the manhole? ANSWER - The manhole as shown on the drawing, page 8 of 16, note 2 for project 692-06-103. The manhole will be used as access when necessary, like any other manhole. 3.45 Question - The drawings stipulate a foot valve on the suction stub in the tanks. Typically a check valve is used at the pump to meet DEQ regulations. Should a check valve be bid instead of a foot valve? ANSWER - If the contractor can provide a specific code reference for the use of a check valve instead or in addition to a foot valve, then we take no exception. 3.46 Question - The specs do not provide an anti-siphon valve for the supply piping. Should the price for the valve be incorporated since this is a standard for and above ground tank? ANSWER - We take no exception to the installation of an anti-siphon valve at the tank. 3.47 Question - Is this project funded or is award based on availability of funds? ANSWER - Funds are available, based on current estimates for the project. 3.48 Question - Is a copy of the analytical report for the contaminated soil, the amount of samples taken and the locations of the samples available for review? ANSWER - The only geologic information available is in the February 2007 Subsurface Soil and Groundwater investigation report which will be available as reference material only. Site conditions may have changed since the report was finished.. 4) Section 4.24 52.252-2 CLAUSES INCORPORATED BY REFERENCE (FEB 1998) is modified to include the following clauses: 52.204-9 Personal Identity Verification of Contractor Personnel (SEPT 2007) 52.222-50 Combating Trafficking in Persons (AUG 2007) 52.232-34 Payment by Electronic Funds Transfer-Other than Central Contractor Registration (MAY 1999) 52.236-13 Accident Prevention (NOV 1991) 52.244-2 Subcontracts (J UNE 2007) 52.245-1 Government Property (JUNE 2007) 52.245-9 Use and Charges (JUNE 2007) 52.246-12 Inspection of Construction (AUG 1996) 52.249-2 Termination for Convenience of the Government (FixedPrice) (MAY 2004) 5) Section 4.24 52.252-2 CLAUSES INCORPORATED BY REFERENCE (FEB 1998) is modified to delete the following clauses or provisions: 52.219-25 Small Disadvantaged Business Participation Program-Disadvantaged Status and Reporting (OCT 1999) 52.246-13 Inspection-Dismantling, Demolition or Removal of Improvements (AUG 1996) 52.249-3 Termination for Convenience of the Government (Dismantling, Demolition, or Removal of Improvements) (MAY 2004) 6) The following clauses are incorporated: Section 4.25 852.236-71 Specifications and Drawings for Construction (JUL 2002) The clause entitled "Specifications and Drawings for Construction" in FAR 52.236-21 is supplemented as follows: (a) The contracting officer's interpretation of the drawings and specifications will be final, subject to the disputes clause. (b) Large scale drawings supersede small scale drawings. (c) Dimensions govern in all cases. Scaling of drawings may be done only for general location and general size of items. (d) Dimensions shown of existing work and all dimensions required for work that is to connect with existing work shall be verified by the contractor by actual measurement of the existing work. Any work at variance with that specified or shown in the drawings shall not be performed by the contractor until approved in writing by the contracting officer. (End of Clause) Section 4.26 852.236-84 Schedule of Work Progress (NOV 1984) (a) The contractor shall submit with the schedule of costs, a progress schedule that indicates the anticipated installation of work versus the elapsed contract time, for the approval of the contracting officer. The progress schedule time shall be represented in the form of a bar graph with the contract time plotted along the horizontal axis. The starting date of the schedule shall be the date the contractor receives the "Notice to Proceed." The ending date shall be the original contract completion date. At a minimum, both dates shall be indicated on the progress schedule. The specific item of work, i.e., "Excavation", "Floor Tile", "Finish Carpentry", etc., should be plotted along the vertical axis and indicated by a line or bar at which time(s) during the contract this work is scheduled to take place. The schedule shall be submitted in triplicate and signed by the contractor. (b) The actual percent completion will be based on the value of installed work divided by the current contract amount. The actual completion percentage will be indicated on the monthly progress report. (c) The progress schedule will be revised when individual or cumulative time extensions of 15 calendar days or more are granted for any reason. The revised schedule should indicate the new contract completion date and should reflect any changes to the installation time(s) of the items of work affected. (d) The revised progress schedule will be used for reporting future scheduled percentage completion. (End of Clause) Section 4.27 852.236-87 Accident Prevention (SEPT 1993) The Resident Engineer on all assigned construction projects, or other Department of Veterans Affairs employee if designated in writing by the Contracting Officer, shall serve as Safety Officer and as such has authority, on behalf of the Contracting Officer, to monitor and enforce Contractor compliance with FAR 52.236-13, Accident Prevention. However, only the Contracting Officer may issue an order to stop all or part of the work while requiring satisfactory or corrective action to be taken by the Contractor. (End of Clause) 7) Deliverables/Milestones, Item 1, Progress Schedule is changed to read as follows: Progress Schedule provided by Contractor (start date would be the date of receipt of Notice to Proceed) within 15 days of Notice to Proceed. 8) Deliverables/Milestones, Item 2, due date is changed to read as follows: TBD 9) Deliverables/Milestones, Item 4, Description is changed to read as follows: Contract status report - every 30 days after Notice to Proceed. 10) Working Hours, page 9 is changed to read as follows: Regular hours are 8:00 am to 4:30 pm, local time, Monday through Friday except for Federal Holidays. Work outside the normal working hours when directed by the VA must be with the written approval of the Contracting Officer unless those hours have been included in the contract. Work outside these hours at the request of the Contractor shall not result in any increase in price. 11) Instruction for the Preparation of Technical and Business Proposals, page 10, paragraph (a)(1) is changed to read as follows: The proposal must include a technical and business proposal. Each of the parts shall be separate and complete so that evaluation of one may be accomplished independently from evaluation of the other. 12) Instruction for the Preparation of Technical and Business Proposals page 10, paragraph (a)(3) is changed to read as follows: The Government will evaluate proposals in accordance with the evaluation criteria set forth in this RFP. 13) Evaluation Criteria, Past performance, paragraph (a)(2) is changed to read as follows: In order to evaluate your company's past performance, the Government will review the Offeror's response to this evaluation criteria. The Government may also contact other Federal, State and local Government agencies, better business bureaus, published media, and electronic databases. Government evaluators may also use their personal knowledge of, and experience with, the firm(s) being evaluated. Note: In accordance with FAR 15.305, in the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the Offeror will not be evaluated either favorably or unfavorably on this criteria, but instead will receive a neutral rating for this criteria. 14) Evaluation Criteria Price Proposal is changed to read as follows: This criterion will include consideration of cost information provided to support item prices entered in Section B, Schedule of Items. A detailed cost breakdown is not required. 15) Evaluation Criteria, Award Statement is changed to read as follows: All evaluation factors other than price, when combined are approximately equal to cost or price. 1)Technical proposals will be evaluated and ranked by an evaluation panel according to the criteria in this RFP. The panel will not have access to the price proposal during the technical evaluation process. 2)The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarification as described in FAR 15.306(a). Proposals should be submitted initially on the most favorable terms, from a price and technical standpoint, which the offeror can submit to the Government. However, the Government may, after evaluation of proposals, conduct further oral or written discussions as appropriate, with all offerors whose proposals are within a competitive range.
