This is a combined synopsis/solicitation for commercial service prepared and processed in accordance with the Federal Acquisition Regulations (FAR) Part 12.6 as supplemented with additional information included in this announcement. This is a Solicitation for the United States Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS), Office of Habitat Conservation, located in Silver Spring, MD is seeking services for removal of illegal lobster fishing devices & marine debris (Casitas) from waters of the Florida Keys National Marine Sanctuary. This constitutes the only Request For Quote (RFQ), written quotes are being requested; and a written solicitation will not be issued. DOC, CRAD requires that all contractors doing business with this office be registered with the Central Contractor Registry (CCR). No award can be made to a company not registered in CCR. For additional information and to register in CCR, please access the following web site: http://www.ccr.gov. In order to register, all offerors must have a Dun & Bradstreet Number. A Dun & Bradstreet number may be acquired free of charge by contacting Dun & Bradstreet on-line at https://www.dnb.com/product/eupdate/requestOptions.html or by phone at (800) 333-0505. Contractors shall submit their Online Certification and Representations (ORCA) thru the on-line Business Partner Network (BPN). The BPN is the single source for vendor data for the federal government. Contractors are encouraged to go on-line at www.bpn.gov to complete its representations and certifications. Completion of representations and certifications is a requirement for award. This notice is hereby issued as RFQ No. NFFKHC30837246PWS. This RFQ and the incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-24. The FAR clauses and provisions incorporated into this acquisition shall be: 52.212-1, Instruction to Offerors - Commercial Items (Nov 2007), 52.212-3 Offeror Representations and Certifications - Commercial items (Nov. 2007), 52.212-4 Contract Terms and Conditions - Commercial Items (Feb. 2007), 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (Feb 2008) (Sections 5, 15, 16, 18, 19, 21, 24, 31, 36, (c)(1), and (c)(2)), 52.217-5, Evaluation of Options (July 1990), 52.217-7 -- Option for Increased Quantity -- Separately Priced Line Item (Mar 1989)The Government may require the delivery of the numbered line item, identified in the Schedule as an optional task, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within 365 days of contract award. Delivery of the added service shall continue at the rate identified in the optional task, unless the parties otherwise agree, 52.247-35 FOB Destination, Within Consignee's Premises (Apr.1984). The following Commerce Acquisition Regulations (CAR) clauses and provisions are also incorporated into this acquisition by reference: 1352.201-70 Contracting Officer's Authority (Feb. 2005), 1352.211-70 Statement of Work/Specifications (Mar. 2000), 1352.215-70 Period of Performance (Mar. 2000){The period of performance will be from date of award through December 31, 2008}, 1352.215-77 Evaluation Utilizing Simplified Acquisition Procedures (Mar 2000) The Government will award a purchase order resulting from this request to the responsible firm whose quotation conforming to the request results in the best value to the Government price and other technical factors considered. The following factors shall be used to evaluate quotes: Technical: Approach, Equipment, Personnel Qualifications, Past performance, and Past experience (shall include expertise and experience with marine debris removal); and, Price (Price per day). Technical Factors are relatively equal in importance. Price is more important than technical. 1352.239-73 Security Requirements for Information Technology Resources (Oct. 2003), 1352.246-70 Inspection and Acceptance (Mar. 2000). Inspection and acceptance will be performed at, NMFS Office of Habitat Conservation ~ Restoration Division, 263 13th Ave South, St. Petersburg, FL 33701. In addition to price, offers must include the following for evaluation: 1. Brief, succinct cover letter expressing interest in responding to this announcement and deliverables that includes a description of the proposed approach to be utilized that will enable the contractor to complete the project and provide the deliverables as described herein. 2. A summary of the type, number and quality of vessel(s) and shore based equipment needed to remove, transport, transfer and haul up to 6 tons of debris safely from the dive site to shore for deposition daily. 3. Personnel Qualifications (Licensed Captain, experienced deck hands, equipment operators and certified divers) who adhere to all safety regulations. 4. Knowledge and experience working and navigating within the waters of the Florida Keys National Marine Sanctuary. 5. Knowledge and experience as professional divers conducting this kind of debris removal work. 6. Past performance references (at least two) for requirements that are comparable to those stated within. Past performance should include expertise and experience with marine debris removal. Provide customer points of contact for stated projects. 7. A completed price breakdown for all line items identified in this notice. See requirements listed below under Proposal requirements. 8. FAR provision 52.212-3 Offeror Representations and Certifications - Commercial Items (completed), or a statement verifying that this has been done through ORCA. 9. Certification of registration in the Central Contractor Registration database. This is a firm fixed price request for quote. Background: NOAA's Restoration Center, the Florida Keys National Marine Sanctuary and Southeast Fisheries Science Center are partnering with the State of Florida and the U.S. Fish and Wildlife Service to locate and remove illegal lobster condos or "casitas" within the waters of the Florida Keys National Marine Sanctuary. Casitas are simply a flat sheet of waterproof material (steel, cement, tin, etc.) propped 4-6" above the seafloor on cement parking blocks or similar structures, creating an ideal habitat for lobster. These casitas smother the seafloor by shading out the substrate and concentrate lobsters allowing for increased harvest through illegal fishing. Florida law prohibits harvesting spiny lobster on non-permitted artificial structures. In addition, these condos violate FKNMS dumping regulations as well as cause destruction of natural resources. In 2007, NOAA technicians conducted the side scan sonar survey over an area approximately 12 square miles north of the lower Keys to locate the illegal fishing gear. NOAA contractors visited over 100 target sites and removed over 60 of the illegal structures from the seafloor. The debris was measured for surface area, brought to the surface and then transported to shore for disposal on land. The activities in this SOW are part of an ongoing effort to continue to remove casita's from the Florida Keys National Marine Sanctuary. Work to be performed: On behalf of NOAA the contractor shall conduct the removal of marine debris that has been illegally dumped on the seafloor. The area of work will be the north side of the Lower Florida Keys from approximately Big Pine Key through Key West in 10' to 40' of water. The contractor must be able to navigate to the identified targets, deploy divers to attach cables and/or lift bags to bring the casitas to the surface, use a lifting device to lift casitas onto a floating platform/vessel, transport debris to shore, and remove debris to an approved landfill facility outside of the Florida Keys. The Contractor shall provide all personnel, materials, equipment, and services needed to remove debris from the seafloor and have it removed from the Florida Keys National Marine Sanctuary. (a) The contractor shall perform the following work for Casita removal 1: Locate debris sites from provided Lat/Long coordinates and locate debris/casitas on the seafloor from a minimum of five sites daily 2: Attach cables/lift bags/other lifting devices to debris on seafloor for transportation to surface 3: Collect debris/casita from the surface and place onto barge/vessel/or other floating platform 4: Transport debris to shore to deposit into vehicles/trucks for removal 5: Deliver debris to landfill outside of the Florida Keys 6: Document activities with photos/video and a receipt from the landfill 7: Work in concert with Florida Fish and Wildlife Conservation Commission Law Enforcement, NOAA and FDEP staff. 8: Travel to and from sites at own expense (b) The contractor shall have and provide the following resources: 1: Vessel and shore based equipment needed to remove, transport, transfer and haul up to 6 tons of debris safely from the dive site to shore for deposition daily. 2: A competent crew and certified divers who adhere to all safety regulations 3: Knowledge and experience navigating within the Florida Keys National Marine Sanctuary 4: Knowledge and experience as professional divers conducting this kind of debris removal work Additional Information: NOAA will identify the locations for the casita removal. Accurate removal is necessary so as not to injure surrounding habitat and the contractor shall be responsible for any additional damage to the resources. NOAA/FKNMS staff will provide on-site guidance in the field for the job. Proper disposal is important so that these materials will not be reused as casitas. Law Enforcement officers will monitor disposal. Factors to Consider: (a) Site Work and Conditions 1. Sudden and intense rain squall with the possibility of cloud to sea lightening 2. Limited water visibility sometimes less than 3 feet 3. Rough sea conditions 4. Strong currents 5. Marine life 6. Care when working near living resources on the seafloor, i.e. corals. (b) Base of Operations 1. Will be determined by NOAA and contractor (c) Weather 1. Site conditions at can vary day to day. 2. The depth of water for the task is between 15 and 40 feet. 3. The vessel captain and project manager (with consultation to the NOAA project manager) will responsible for making the call when to not get underway, turn back, or terminate operations due to weather. 4. In the event that operations are cancelled prior to commencing operations it shall be considered a weather day, Partial days (due to weather) shall be billed on a proportional basis. 5. If operations are terminated for weather once work at the site has commenced it shall be billed as a partial operational day and billed proportionally for time worked. (d) Vessels and Equipment Failure 1. The contractor is responsible for maintaining all contractor (including subcontractor) provided equipment & vessels in a safe operating condition during the contract performance. If a mechanical breakdown occurs of any of the equipment or vessels the equipment and/or vessel shall be considered off the contract for the purposes of billing. The contractor should make every reasonable effort to solve any problem casing the equipment or vessel to be out of service, and bring it back into service (or provide a replacement) as quickly as possible to continue contract performance. 2. If field work is canceled for due a condition outlined above the contractor may not bill for the equipment or vessel in question. (e) Safety 1. The Contractor will be required to prepare a dive accident management plan and a site safety plan as part of mobilization. 2. The project manager is responsible for overall safety of all personnel. 3. All vessels must be operated by appropriately licensed individuals, be in good/safe working order, maintain a diving first kit and portable emergency oxygen (2 hour supply). Period of Performance: Task 1 - Removal of additional illegal lobster fishing devices and marine debris (Casitas) from the waters of the Florida Keys National Marine Sanctuary - Date of award through December 31, 2008. The contractor must be mobilized and beginning field operations within four weeks after being given notice to proceed by NOAA (operations are anticipated to begin in July 2008). Once field operations begin they shall be continuous until released by NOAA (with the exception of weather days and authorized down days). NOAA anticipates a daily effort that will include diving between 5 and 10 sites daily and removing, transporting, transferring, and disposing of 2 tons or 20m2 of material removed from the seafloor daily, the contractor would not be expected to remove more then 6-8 tons of material daily. Optional Task 2 - Removal of additional illegal lobster fishing devices and marine debris (Casitas) from the waters of the Florida Keys National Marine Sanctuary may be exercised at the Government's discretion within 365 days of contract award. Period of performance for Optional Task 2 shall be 180 days after exercise of optional task. Optional Task 3 - Removal of additional illegal lobster fishing devices and marine debris (Casitas) from the waters of the Florida Keys National Marine Sanctuary may be exercised at the Government's discretion within 365 days of contract award. Period of performance for Optional Task 3 shall be 180 days after exercise of optional task. Proposal Requirements: Further definition of the price proposal requirements is as follows: The contractor shall provide NOAA with written price proposal that provide a separate cost breakout for the Number of full field operational days where debris removal can take place for $30,000, this should factor in the cost of mob/demob, complete weather days, partial weather days and any economy of scale for multiple days. A full operational is considered six hours on-the-water and operational, not including transit time and unloading of debris. Partial days (due to weather) shall be billed on a proportional basis. Information for vendor: The contractor will provide an invoice once task is complete. Invoice shall also include the amount of debris removed and number of days worked per task. The contractor will provide all equipment necessary to perform the tasks described above. The contractor shall be responsible for accounting for weather delays in their cost estimate, and there will be no provision for reimbursement to the contractor for additional work days lost due to weather. There are no benefits and the contractor is responsible for payroll taxes and insurance including medical. The contractor shall not be deemed a Federal employee for any purposes including Federal Tort Claims Act and Federal Employee Compensation Act purposes. IT SECURITY REQUIREMENTS: The Certification and Accreditation Requirements for the Department of Commerce clause 1352.239-73 do not apply, and a Security Accreditation Package is not required. NOTE: THE ABOVE ARE MIMUMUM REQUIREMENTS.
