Description
Description / Specifications STATEMENT OF WORK 1. SCOPE OF CONTRACT; The contractor shall furnish all supervision, personnel, equipment, transportation, repair services and all other items necessary to provide collection, storage, removal, transport and disposal of regulated non-hazardous waste (General Solid Waste), including construction debris and discarded furniture that is generated at the West Palm Beach Veterans Medical Center located at 7305 N. Military Trail, West Palm Beach, Florida. This contract excludes regulated medical waste and hazardous waste. The contractor shall comply with all county, municipal or state and federal laws, regulations and guidelines when collecting, storing, removing, transporting, disposing of and/or recycling all wastes under the scope of this contract. The contractor must be authorized (franchised) to perform these services by the Palm Beach County Solid Waste Management department throughout the effective period of this contract. The contractor shall provide the compactor and containers on an as-required basis and in the appropriate sizes to adequately serve the facility needs. Frequency of pick ups of the compactor and containers shall be at the discretion of the VA Medical center to insure facility needs are met. 2. LOCATIONS AND COLLECTION REQUIREMENTS; 2.1 Compactor: The contractor shall provide one compactor which will be located at receiving dock # 5. Pick up shall be accomplished three times per week, Monday, Wednesday and Friday between the hours of 7:00am and 4:30pm. The compactor shall be of an appropriate size and capacity to adequately meet the facility needs, as approved by the VA Medical Center. Informational Note: Historically a 30 cubic yd. compactor with three pick ups per week has been adequate. The contractor shall employ a method of reducing bacterial growth and offensive odor subject to approval by the VA Medical Center. The contractor shall provide at no additional cost, all necessary initial installation, preventive maintenance and remedial repairs to the compactor to ensure maximum up time. Critical: If the compactor will not be available for more than a three hour period at any time, a replacement compactor or appropriate size container shall be immediately provided at no additional cost, with appropriate frequency of pick ups in order to avoid a buildup of waste at the facility. 2.2 20 and / or 30 cubic yard containers: The contractor shall provide 20 and/or 30 cubic yard containers in the quantities and in the locations deemed necessary by the VA Medical Center. At the beginning of the contract a schedule will be established by the VA Medical Center listing the size, locations and required number of weekly pick ups. Informational Note: Historically the facility has required three containers permanently located at the site with a pick up of once per week with additional containers required occasionally throughout the year for special projects. Additional containers may be required for special projects on an as needed basis with required duration and frequency of pick ups as deemed necessary by the VA Medical Center. The VA Medical Center reserves the contractual rights to order pick ups more frequently if required at no additional cost. These additional pick ups shall be accomplished by the contractor within twenty four (24) hours of the request. 2.3 8 or 10 cubic yard containers: Containers shall be provided in the quantities and in the locations deemed necessary by the VA medical Center with pick ups accomplished as deemed necessary by the VA Medical Center. At the beginning of the contract a schedule will be established by the VA Medical Center listing the locations and required weekly pick ups. Informational Note: Historically the facility has required three containers permanently located at the site with pick up twice per week with additional containers required occasionally throughout the year for special projects. Additional containers may be required for special projects on an as needed basis with required duration and frequency of pick ups as deemed necessary by the VA Medical Center. The VA Medical Center reserves the contractual rights to order pick ups more frequently if required at no additional cost. These additional pick ups shall be accomplished by the contractor within twenty four (24) hours of the request. 2.4 Maintaining containers and collection areas: The contractor shall return the containers to their original location after servicing in an upright position with the lids securely in place (closed). The contractor shall also be responsible for immediately cleaning up any spills, debris, etc. that may occur during servicing of containers. All refuse on the ground that is spilled by the contractor shall be immediately picked up by the contractor during collection. The contractor shall collect debris placed at the collection areas: for example, tree branches, sacks, cartons, boxes, cans, tied bundles or other containers. 3. GENERAL REQUIREMENTS; 3.1 Toll free emergency number(s): The contractor shall provide emergency numbers for purposes of accepting service calls available 24 hours per day 7 days a week. Normally emergency service calls will be placed by the contracting officer or COTR, however other VA personnel may place emergency service calls dependent upon the circumstances. The VA will notify the contractor of any equipment malfunction or service needs with as much information as can be ascertained. The contractor's response time shall be appropriate considering the nature of the emergency type of container etc. Rapid response to any issue involving the compactor is of paramount importance considering the constant flow and volume of waste generated. Weather emergencies such as hurricanes may also necessitate service requirements for which the contractor shall respond in as expeditious a manner as possible. 3.2 Contamination by Bio-Medical Waste: Any suspected or actual contamination by bio-medical waste or hazardous waste shall be immediately brought to the attention of the VA and shall not be transported for disposal. 3.3 General Solid Waste: The waste specified under the conditions of this section of the contract is referred to as General Solid Waste. Since all waste is regulated this waste is referred to as Regulated Non-Hazardous waste. This contract includes all general solid waste generated by the facility other than Bio-Medical Waste, sharps, hazardous waste materials and waste and recyclable materials. The contractor shall transport all waste employing methods and procedures that fully comply with all local state and federal laws and regulations. The contractor shall furnish the VA with a fully detailed written description and procedural manual of the methodology that will be used to transport treat and dispose of solid waste. This must include all related and applicable permits and licenses. All containers for storage and transportation of any classification of waste or recyclable materials must clearly be marked with the department of Transportation (D.O.T.) permit number. 3.4 Title: The contractor shall take title once the waste is fully loaded into contractor furnished vehicles. 3.5 Off Site Disposal: The contractor shall transport and dispose of all solid waste at a licensed off-site Palm Beach County disposal site selected by the contractor. Disposal shall be in accordance with existing local state and federal regulations. The contractor shall be responsible for any permit or fees associated with the use and site of disposal location. 3.6 Quality Control: The contractor shall develop and maintain a quality control program to ensure services are performed in accordance with commonly accepted commercial practices. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurring of defective services. As a minimum the contractor shall develop quality control procedures addressing the areas identified in paragraph 5.0, service delivery summary. The contractor shall provide and maintain a written safety plan that will be undertaken to protect the staff of the VA Medical Center and contractor including the surrounding community. The contractor shall provide a detailed written description of all procedures for transporting storage treatment and disposal. 3.7 Insurance: The contractor shall provide documentation of indemnity to the VA Medical Center against liability from its willful misconduct, negligence or breach of contract. Other insurance requirements are specified herein contract clauses 52.228-5 and 852.237-70. In accordance with FAR 28.307-2 and the clauses stated herein the following minimum coverage shall apply to this contract; (a) Workers compensation and employers liability: Contractors are required to comply with applicable Federal and state workers compensation and occupational disease statues. If occupational diseases are not compensable under those statues they shall be covered under the employers liability section of the insurance policy except when contract operations are so commingled with a contractors commercial operations that it would not be practical to require the coverage. Employer's liability coverage of at least $100,000 shall be written by private carriers. (b) General liability, $500,000 per occurrence. The contractor must maintain general liability insurance of at least $500,000 per occurrence without any exclusionary clauses for asbestos. (c) Automobile liability, $200,000 per person; $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims. 3.8 Permits and Licensing: The contractor shall provide copies of all applicable permits and licenses such as a disposal facility permit, waste and transportation licenses incinerator permit or recycling facility permits. The contractor shall provide proof of regulatory compliance such as inspection reports policies and procedures staff training records, and emergency plans. 3.9 Safety Requirements: In the performance of this contract the contractor shall take such safety precautions as the contracting officer or COTR may determine to be reasonably necessary to protect the lives and health of all personnel at the facility. The contracting officer or COTR will notify the contractor of any noncompliance with the foregoing provisions and the action to be taken. The contractor shall, after receipt of such notice immediately correct the conditions to which Attention has been directed. Such notice when served on the contractor or his representative at the work site shall be deemed sufficient for the purpose aforesaid. If the contractor fails or refuses to comply promptly the contracting officer may issue an order stopping all or any part of the work and may ultimately terminate for default. 3.10 Quality Assurance: The VA will periodically evaluate the contractor's performance by appointing a Contracting Officer's Technical Representative (COTR) to monitor performance to ensure services are received in a satisfactory manner. The VA will evaluate the contractor's performance through intermittent on-site inspections of the contractor's quality control program and via receipt of complaints from VA personnel. The VA may inspect each task as completed or increase the number of quality control inspections if deemed appropriate because of repeated failures discovered during quality control inspections or because of repeated complaints. Likewise the VA may decrease the number of quality control inspections if performance dictates. The VA will also receive and investigate complaints from various personnel located at the site. The contractor shall be responsible for initially validating customer complaints. However the VA will make final determination of the validity of customer complaints in cases of disagreement with customers. 3.11 Invoicing: Invoices for payment shall be submitted in areas after the4 service is performed. Monthly invoicing is recommended. The following information must appear on invoices; . Contractor's name/address/phone number . Contract number . Purchase Order (PO) number (will be provided by the VA each year) . Date(s) of pick ups . Corresponding contract pricing (per pull or per ton) . Total invoice amount Note: Invoice $ amounts must match the agreed upon contract pricing. Invoices listed incorrect information such as incorrect $ amounts unallowable charges etc. will be returned unpaid to the contractor for correction. Note: Service holds or "credit holds" which result in a disruption of service will not be allowed. Any invoicing/payment problem which cannot be resolved through the usual process of resolution by those responsible for this process should be referred to the Contracting Officer. The contractor's actual or threatened incidences of credit holds will likely result in the contract's options not being extended by the VAS and could also lead to termination of the contract for default. 4. SERVICE DELIVERY SUMMARY; The contractor service requirements are summarized into primary performance objectives. The performances threshold briefly describes the minimum acceptable levels of service provided for each requirement. These thresholds are considered critical to acceptable performance.
