Description
This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the information in FAR Subpart 12.6, using Simplified Acquisition Procedures under the test program for commercial items found at FAR 13.5, as supplemented with the additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. This combined synopsis/solicitation SHALL be posted on both FEDBIZOPPS and NECO (http://www.neco.navy.mil/ ). The RFQ number is N00244-07-T-0891. This solicitation documents and incorporates provisions and clauses in effect through FAC 2005-20 and DFARS Change Notice 20070828. It is the responsibility of the contractor to be familiar with the applicable clauses and provisions. The clauses may be accessed in full text at these addresses: www.acqnet.gov/far and http://www.acq.osd.mil/dpap/dfars/index.htm . The NAICS code is 334516 and the Small Business Standard is 500 employees. This is a sole source action with TA Instruments. The Fleet and Industrial Supply Center San Diego requests responses from qualified sources capable of providing the following items: Description Part # Q800 Dynamic Mechanical Analyzer 985000.901 Gas Cooling Accessory 991400.902 Q20 Differential Scanning Calorimeter 970500.902 Refrigerated Cooling System 970508.901 Tzero Press and Die Sets Kit 901600.901 Kit Ethernet Switch 924500.602 Installation and Training 924999.901 Shipping N/A The requirement is for a firm fixed price supply contract, and delivery is 6 weeks after date of order. Responsibility and Inspection: FOB Destination with Inspection/Acceptance at Destination. The above items are used by the Naval Postgraduate School Mechanical Engineering department as part of their research and teaching curriculum program. TA Instruments is the only known vendor that can manufacture both the Differential Scanning Calorimeter (DSC) and the Dynamic Mechanical Analyzer (DMA). This feature represents a critical benefit to the Naval Postgraduate School, because it is essential that both these pieces of equipment, as well as the computer control system are serviced by the same company. Both pieces hold patents and involve proprietary design features that prohibit service and maintenance from outside vendors. Additionally, due to the nature of research conducted with this equipment, TA Instruments is the only vendor with the capability to achieve the leve l of desired results. The equipment must have the capability of operating at a temperature range of -180-725 degrees Celsius, for the purposes of cryogenic research. Furthermore, the force range must also span from .0001 to 18 Newtons for measurements on thin films, fibers, etc. Extensive market research has proven TA Instruments to be the only vendor capable of providing equipment with the aforementioned capabilities. The following FAR provisions and clauses are applicable to this procurement: 52.212-1, Instructions to Offerors - Commercial Items; 52.212-3 and its ALT I, Offeror Representations and Certifications - Commercial Items; 52.212-4, Contract Terms and Conditions - Commercial Items with the following applicable clauses FAR 52.211-5, Material Requirements and 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items with the following applicable clauses for paragraph (b): FAR 52.222-26, Equal Opportunity; FAR 52.222-35, Affirmative Action for Disabled Veterans and Veterans of the Vietnam Era, FAR 52.222-36, Affirmative Action for Workers with Disabilities; FAR 52.222-37, Employment Reports on Disabled Veterans and Veterans of the Vietnam Era. Provision 52.212-2, Evaluation ? Commercial Items, applies with paragraph (a) completed as follows: Award will be made to the offeror that meets the solicitation?s minimum criteria for technical acceptability at the lowest price. To be determined technically acceptable, the offeror must furnish product literature that demonstrates the products offered meet all requirements stated in the above purchase descriptions for Line Items 0001 through 0008. Quoters shall include a completed copy of 52.212-3 and its ALT I with quotes. Additional contract terms and conditions applicable to this procurement are: 252.212-7000, Offeror Representations and Certifications - Commercial Items and 252.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items including the following clauses applicable for paragraph (b): DFARS 252.225-7001, Buy American Act and Balance of Payment Program; DFARS 252.225-7012, Preference for Certain Domestic Commodities; and DFARS 252.225-7036, North American Free Trade Agreement Implementation Act The Year 2000 Warranty - Commercial Items applies. This announcement will close at 4 PM PST on Wed 12 Sept 2007. TA Instruments is the only source able to provide the supplies described above. Interested parties may identify their interest and capability to perform by contacting the Contracting Officer no later than 11 Sept 2007. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete the proposed contract based upon responses to this notice is solely within the discretion of the Government.
