Description
THIS IS A REQUEST FOR INFORMATION ONLY AND YOUR RESPONSE IS NOT AN OFFER. THIS REQUEST FOR INFORMATION DOES NOT COMMIT THE GOVERNMENT TO PAY ANY COSTS INCURRED IN PREPARATION OF ANY SUBMISSION TO THIS MARKET SURVEY, OR TO CONTRACT FOR SERVICES. Military Sealift Command (MSC) utilizes non-personal services in the areas of marine engineering, naval architecture, electrical and electronics engineering, maintenance engineering, shipboard testing, and failure analysis. A Request for Proposal (RFP) for the T-AOE 6 Class Machinery Control System will be issued within the next several months by MSC. Prior to issuing the RFP, MSC must verify if potential offerors are in compliance with the International Traffic in Arms Regulations (ITAR). In accordance with Title 22 from the Code of Federal Regulations (CFR) Sections 120-130, ITAR is a set of United States government regulations that control the export and import of defense-related articles and services on the United States Munitions List. These regulations implement the provisions of the Arms Export Control Act, and are described in Title 22 (Foreign Relations), Chapter I (Department of State), Subchapter M of the Code of Federal Regulations. The upcoming solicitation will not contain technical data subject to the ITAR and may be exported to foreign persons. However, the T-AOE 6 Class Machinery Control System equipment and the Government Furnished Information (GFI) are considered to be defense articles subject to ITAR, therefore potential offerors which intend to export or to temporarily import a defense article must obtain the approval of the Directorate of Defense Trade Controls (DDTC) prior to the export or temporary import. The appropriate license form must be submitted for the purpose of seeking approval. Please see the Directorate of Defense Trade Controls web page for additional information: http://www.pmddtc.state.gov/itar_index.htm. An award will not be issued to a Contractor who is not in compliance with the provisions of ITAR, the Arms Export Control Act or any other U.S. laws/regulations regarding the conduct of business outside the United States. MSC is requesting for potential offerors to confirm if it is envisioned that this procurement will require data to be either exported or imported to foreign countries. Additionally, potential offerors are asked to confirm if they are intend to comply with ITAR in the event an export license will be needed to export/import defense articles subject to ITAR. Responses are due no later than COB August 16, 2007 at 3:00pm.
