Description
NAICS Code: 334516 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Solicitation number RFQ-KS-07-00023 is applicable and is issued as a request for quotation. The solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular. This acquisition is 100% set-aside for small business. The North American Industry Classification System (NAICS) code for this acquisition is 334516 (Analytical Laboratory Instrument Manufacturing) with a size standard of $6.5 million. The description of the commercial items is for SPE-DEX 4790 add-on extractor units and reads as follows: CLIN 1: SPE-DEX 4790 add-on extractor units. CLIN 2: SPE-DEX 4790 Users Manual and Check Sheet CD. CLIN 3: Easy Grip Disk Holders - 47mm. CLIN 4: Easy Grip Disk Holders - 90mm. CLIN 5: Check Valve Release Tool. CLIN 6: Solvent Delivery Manifold - Expansion Kit. The selection resulting from this request for quotation will be made on the basis of best value to the Government. Once the Contracting Officer has decided to whom an order will be issued, a unilateral order will be issued using an Optional Form 347. A purchase order will be in existence once the Contracting Officer has signed the order. Wherever the words offer, proposal, offerors, or similar terms are used in this solicitation or in any applicable provision, they shall be read to mean quote, quotation, quoter, vendor or similar corresponding term to reflect that this solicitation is a Request for Quotation not a Request for Proposal or an Invitation for bid. Provision 52.212-1, Instructions to Offerors-Commercial Items, applies to this acquisition. The Contracting Officer will evaluate quotes on the basis of information furnished by the quoter that demonstrates that the quote meets the agency's minimum requirements. The Contracting Officer is not responsible for locating or obtaining any information not identified in the quote. Telephonic inquiries will not be accepted. Quotes must be submitted by mail and/or email and are due on August 14, 2007 at 12:00 PM Central Daylight Saving Time (CDT) along with the completed representations and certifications, providing the business size, e-mail address, Dunn and Bradstreet number, CAGE code and Federal Tax ID number. In addition, quoters must be registered in the Central Contractor Registration database at www.ccr.gov to be considered for selection. Quoters are required to submit completed copies of the provisions at FAR 52.212-3 and its ALT I, Offeror Representations and Certifications - Commercial Items, with their quotes. FAR clause 52.212-4, Contract Terms and Conditions Required to Implement Statutes or Executive Orders, Commercial Items, applies to this acquisition. The following clauses are applicable to this acquisition: 52.217-9, 52.219-6, 52.219-14, 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.222-39, 52.222-41, 52.223-6, 52.245-2 and 52.246-4. Instructions: Offerors shall submit a detailed quote to the contract specialist for each contract line item number (CLIN). All interested firms shall submit their quotes to Contract Specialist, Tyrone Lewis, at: U.S. EPA egion 7, PLMG/RFMB, 901 N. 5th St, Kansas City, KS, 66101 or lewis.tyrone@epa.gov no later than August 14, 2007 at 12:00 pm CDT. SOLE SOURCE JUSTIFICATION I. DESCRIPTION OF THE SUPPLIES/SERVICES: Environmental Protection Agency ? Regional Laboratory. This sole source justification is for the purchase four SPE-DEX 4790 add-on extractor units (and 1 SPE-DEX 4790 users manual), four easy grip disk holders - 47mm, four easy grip disk holders - 90mm, one check valve release tool, and two solvent delivery manifold expansion kits. II. STATEMENT OF FACTS JUSTIFYING SOLE SOURCE AWARD: The equipment being purchased are add-ons to existing EPA extractor units. Horizon Technology, Inc. is the only company to manufacture, sell and service the model 4790 automated solid phase extraction system. Use of other brand name extraction systems would require EPA to purchase a complete fully automated solid phase extraction system. Use of another vendor?s equipment would also void the existing service warranty. Horizon Technology, Inc. is the sole provider of the model 4790 automated solid phase extraction system. III. Horizon Technology, Inc. is the only known source able to satisfy the Government?s requirement(s). Horizon Technology, Inc. is the manufacturer of the equipment and they are the only company that offers the SPE-DEX 4790 add on extractors. IV. STATEMENT OF ACTIONS TAKEN TO PRECLUDE THE NECESSITY FOR FUTURE SOLE SOURCE ACQUISITION FOR THE SAME SUPPLIES/SERVICES: This acquisition is for upgrades to an existing system. Manufacturers of similar extraction systems may have the ability to compete for future acquisitions of complete systems.
