Description
U. S. Department of Labor, Office of Job Corps (OJC), Job Corps Data Center intends to negotiate on a sole slource basis with Pearson Print Services, to print a year supply of Student Satifaction Surveys forms. The survey forms were specifically intended to work with the Job Corps Data Center applications and NCS Pearson Scanners. The Competition in Contracting Act, P.L. 98-369, Section 303(c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, allows an agency to use procedures other than competitive procedures when the supplies or services needed are available from only one responsible source and no other type of supplies or services will satisfy agency requirements. Pearson is the only responsible source that can satisfy the OJC?s requirement. This comes as a result of 1) NCS Pearson products are proprietary hardware and software, in which NCS Pearson holds the rights and patents; 2) NCS Pearson provides the services required to print the survey forms that work with NCS Pearson Scanners; 3) NCS Pearson provides the technical expertise required to support their hardware; and 4) NCS Pearson is the sole manufacturer of NCS Pearson products and support services. This notice of intent is not an announcement of the availability of a Request for Proposal (RFP) nor is an RFP available. Any interested party who believes they can provide the required service may respond by submitting a capability statement to the e-mail address in this notice. The capability statement must include price information and describe in detail the parties? ability, qualifications and experience in providing the required service as described above. All submissions must be received by within three business days of the publication date of this synopsis. A determination not to compete the proposed work based upon responses to this notice is solely within the discretion of the Contracting Officer. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement (See Numbered Note 22).
