- See numbered note 1. This synopsis publicizes contract actions proposed to support the US Army Engineering and Support Centers Utility Rate Intervention and Litigation Program. The program provides the U.S. Army, Department of Defense and Federal executive agencies with util ity rate analytical services and representation as expert witnesses before municipal, state and Federal utility regulatory bodies. In order to accomplish this objective, CEHNC proposes to award an Indefinite Delivery Requirements contract, under which fir m-fixed price (FFP) task orders will be issued for acquiring these utility rate services In order to meet the needs of the Utility Rate Intervention and Litigation program, the contractor must be able to provide the following: (a) Professional utility rate analytical and expert witness services that will assist the previously mentioned agencies in participating in utility rate proceedings. Emphasis of the rate intervention services primarily centers on presenting to regulatory bodies and making recommendations of the independent study of professional utility rate analysts in the areas of fair rates of return, appropriate capital structure, cost-of-service based rate design, and equalized returns by customer classes. The Contra ctor shall furnish all service, material, plant, labor, transportation, equipment, studies and superintendence required to provide professional utility rate analytical technical assistance to the said agencies in the conduct of Interventions before the Fed eral Energy Regulatory Commission (FERC), municipal or State utility regulatory bodies which are considering requests for rate increases or other regulatory matters which affect the agencies. (b) Assistance for the installations in competing for utilities. This assistance consists of evaluating the availability of competition for each installation; recommending the best method of purchasing utility services; developing contracts for competing for utility services; and providing technical assistance in evaluating the proposals. Offerors may propose this requirement as a sole contractor, prime contractor with subcontractor(s), a joint venture, or a teaming arrangement. Offerors must be able to perform multiple contracts (task orders) simultaneously in various geographic location s. The proposed ordering period is for one (1) base year and four (4) one-year option periods. The total programmatic requirements expected to be awarded under the Utility Rate Intervention and Litigation Program contract is anticipated to equal approxima tely $3,500,000. The Government will conduct a single competition restricted to small businesses. This synopsis publicizes a proposed solicitation (request for proposal) for the restricted small business set aside competition. Any contract result ing from the proposed solicitation is set-aside for small business concerns. Offers from other than small business concerns shall not be considered. A more detailed description of the acquisition strategy will be provided in the solicitation documents. The small business restricted solicitation will be made available to interested parties through the Federal Business Opportunities website at www.fedbizopps.gov, after the closing date of this synopsis. All responsible small business sources may submit a proposal which will be considered by the agency in accordance with the solicitation requirements. Significant evaluation factors for award are anticipated to include: technical capabilities, management approach, experience, past performance, and price/price-related fac tors.
