Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and A WRITTEN SOLICITATION WILL NOT BE ISSUED. This solicitation is issued as a request for quotation (RFQ) for purchase request F2Q3657088A600 & F2Q3657092A200. The solicitation document and FAR incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-14 and Defense Federal Acquisition Regulation Supplement, Defense Change Notice (DCN) 20061219. The proposed acquisition is a 100% set aside for small business. The NAICS code is 541330 and the small business size standard is $4.5 Millions. Evaluation -- Commercial Items (Jan 1999)(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (i) technical capability of the item offered to meet the Government requirement;(ii) price;(iii) past performance (see FAR 15.304); All three factors have the same value. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer?s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. All offerors should be registered in CCR. 1.0 INTRODUCTION The contractor shall perform storm water and wastewater sampling (SAM), analysis, and interpretation of storm water and wastewater samples collected under direction of the Air Force. The purpose of the project is to meet Langley Air Force Base?s (AFB) sampling, analysis, and limited reporting requirements under, the Clean Water Act (CWA), the Virginia Pollutant Discharge Elimination System (VPDES) Permit VA0083194 (effective date 02 May 2005), and the Hampton Roads Sanitation District (HRSD) Wastewater Discharge Permit 0011 issued to Langley AFB. This contract will be a base year contract and can include up to four additional option years. The contractor shall pay the annual storm water permit fee to the Virginia Department of Environmental Quality (VDEQ) in the amount of $3,400. 1.1 Scope Sample collection and analysis must be subcontracted to a company based in close proximity to Langley AFB (approximately 15 miles). This stipulation is required because storm water samples must be collected within the first hour of measurable discharge as required per VPDES Permit VA0083194. The Base Technical Program Manager (TPM) for this project is listed in Section 2.4. The contractor may also be required to provide a copy of the State laboratory inspection results as well as any follow up reports to correct discrepancies, if any exist. After award of the contract, the contractor will provide the Base TPM with an after-hours telephone number for the laboratory contact. The contractor shall coordinate with the Base TPM to obtain the necessary Base identification passes for sample collection personnel. The laboratory selected by the contractor must have United States Environmental Protection Agency (US EPA), HRSD, and Virginia State Certification. The contractor shall be responsible for sampling and analysis costs. Additionally, any Notice of Violation levied against the Air Force due to the contractor?s delays, late performance, or non-performance, which is not caused by the government, shall be considered grounds for termination for default of this contract. The contractor shall not be held liable for fines and penalties levied against the Air Force due to government error or omission. 1.2 Applicable Laws and Regulations Regulations and permits for Virginia may be more stringent than federal laws and must be considered in assessments. ? Department of Defense (DoD) Directive 6050. 1: Environmental Effects in the United States of DOD Actions, July 1979. ? Occupational Health and Safety Administration (OSHA), Title 29, Code of Federal Regulations (CFR), Part 1910.120, July 1, 1994. ? Clean Water Act (CWA), as amended, 40 CFR 122.41, 1 July 2000. ? Langley AFB Virginia Pollutant Discharge Elimination System Permit (No. VA0083194), 2 May 2005. ? 9 VAC 25-31-10 et seq. ? Virginia Pollutant Discharge Elimination System (VPDES) Permit, 11 April 2001. ? Langley AFB Hampton Roads Sanitation District Permit 0011, October 2006. In addition, the contractor must ensure that the work meets all Air Force requirements and appropriate guidance, to include but not limited to: ? Air Force Instruction AFI 32-7042, ?Solid and Hazardous Waste Compliance,? 12 May 1994. ? AFI 32-7041, ?Water Quality Compliance,? 13 May 1994. ? Air Force Policy Directive (AFPD) 32-70, ?Environmental Quality,? 20 July 1994. 2.0 PROJECT ADMINISTRATION AND MANAGEMENT Project administration and management shall include the development of the project schedule, oversight of the development of the project documents, confirmation notices, conference calls and meetings, and monthly progress and payment tracking reports. The contractor project manager (PM) shall oversee the execution of the project, and be the point-of-contact for this work. 2.1 Site Visits and Meetings ? Agenda and Responsibilities Site visits and meetings are to be combined whenever possible. The contractor shall prepare a meeting notice and agenda for each meeting attended by the contractor. In addition to developing an agenda, the contractor shall prepare a presentation, appropriate for the occasion, and handle the administrative details of the meeting. The administrative details the contractor shall perform, with assistance from the Base TPM, include: set the time and secure the location of the meeting, notify potential attendees of the meeting arrangements, pass out an attendance sheet at the meeting, take notes of salient points of the meeting, prepare and distribute a conference report on the meeting to all attendees within 14 calendar days of the meeting and revise the conference report should the government request it. 2.2 Sampling Plans 2.2.1 Wastewater Prior to initiating fieldwork, the contractor shall provide the Langley AFB TPM a wastewater sampling plan, for monthly and semi-annual wastewater samples to be collected at Building 1370. This monthly sampling plan shall include an alternating workday sampling schedule in accordance with the monitoring requirements in Langley AFB?s HRSD Permit Number 0011. 2.2.2 Storm Water Prior to initiating fieldwork, the contractor and TPM will visit each outfall. The TPM will show the contractor the locations for sampling to occur and discuss the monitoring requirements stated in the Langley AFB VPDES permit. The contractor will then incorporate this information into a plan that includes the sampling locations, monitoring requirements and frequencies. This plan will be provided to the TPM for review and approval. 2.3 Government Furnished Material The Government shall supply, upon request, copies of Langley AFB?s current HRSD Permit 0011 and the VPDES Permit VA0083194. Upon award of the contract, the Government shall also provide, upon request, a copy of the current Langley AFB Storm Water Pollution Prevention Plan. 2.4 Base Technical Program Manager The Langley AFB TPM for this contract are: Ms. Jeree L. Also, 1st Lt Edgar Alonso-Bernal, 1 CONS/LGCS, 74 Nealy Avenue, Langley AFB, VA 23665, (757) 764-2241 Voice, (757) 764-4071 Fax, edgar.alonso-bernal@langley.af.mil 2.5 Monthly Status Reports and Payment Tracking The contractor PM shall develop and submit brief monthly progress reports throughout the duration of this project. The reports shall summarize activities performed during the month; scope of work, budget, and schedule issues; project support required from the Langley AFB TPM; and activities planned for the following month. In addition, the contractor PM shall submit a monthly payment tracking report, which summarizes the budget and cost status of the project. Both the Monthly Status and Payment Tracking Reports shall be submitted electronically to both the Base TPM and Contract Administrator by the 15th day of the following month. 2.6 Analytical Reporting Requirements 2.6.1 Wastewater and Storm Water All written analytical results must be provided to the government immediately upon completion of analysis (within ten calendar days of sample collection date) by telefax to (757) 764-8615. Hard copy results shall be delivered to the following address within 15 calendar days of sample collection to: 1 CES/CEV, Ms. Jeree Grimes, 37 Sweeney Boulevard, Langley AFB, VA 23665-2107. The contractor shall NOT send any analytical results to HRSD or the Virginia Department of Environmental Quality (VDEQ) directly. The contractor shall notify 1 CES/CEV, Langley AFB at (757) 764-1130 of results that are greater than permit limits immediately upon discovery. All analytical detection limits shall be included in laboratory analytical reports to assist in interpreting results. Laboratory QA/QC documentation shall be provided with the respective analytical reports. Suspect or questionable analytical results shall be identified and explained in the laboratory report. 2.7 Training Requirements The contractor shall provide proof of training for laboratory field personnel. Minimum requirements include Hazardous Waste Operations and Emergency Response (HAZWOPER) training and a Field and Laboratory Protocols course (sample collection course). 3.0 ENVIRONMENTAL COMPLIANCE TASKS 3.1 Wastewater Sampling and Analysis Required per HRSD Permit No. 0011 The contractor is responsible for performing all analyses in accordance with applicable State laws, Federal laws, applicable HRSD regulations and requirements, and the HRSD permit held by Langley AFB. The contractor shall perform monthly wastewater analyses at Building 1370 as specified in current HRSD Permit 0011. The contractor?s equipment detection limits shall equal or exceed detection limits specified in the HRSD permit held by Langley AFB. A maximum of 18 respective monthly wastewater samples and analyses for pH and Oil and Grease at Building 1370 shall be collected from January 2008 ? June 2009. All wastewater sampling conducted at Building 1370 shall be accomplished per HRSD Permit No. 0011 by the end of the third week of each month unless otherwise specified by the Air Force. Wastewater monthly samples shall be taken at Building 1370 on alternating days (seven days per week). Semi-annual toxic organics wastewater sampling at Building 1370 shall be conducted in January 2008, July 2008, and January 2009. If monthly wastewater sample results for Building 1370 exceed permit limits, the contractor shall resample the constituent exceeding the permit limitation as required by HRSD Permit Number 0011; a maximum of five monthly respective re-sampling events shall be allowed during the Period of Performance (POP) for this task. 3.2 Storm Water Sampling and Analysis Required per VPDES Permit Number VA0083194 The contractor shall be responsible for performing all analyses in accordance with State and Federal laws, applicable VPDES regulations, and the VPDES permit held by Langley AFB. The contractor shall perform storm water analyses and visual exams as specified in the attached storm water sampling schedule located in Tables 1.a ? 1f. Analytical detection limits must meet or exceed detection limits specified in the VPDES Permit VA0083194 held by Langley AFB. The contractor shall collect and analyze storm water samples as required per VPDES Permit Number VA0083194 during the first qualifying precipitation event for the specified time frame. As required by the VPDES permit, two storm water sampling sets must be submitted each year. No flow reporting is absolutely not allowed under normal conditions. The laboratory hired by the contractor shall also perform and document Quarterly Visual Examinations of storm water discharges per VPDES Permit Number VA0083194. The examinations shall document observations of color, odor, clarity, floating solids, settled solids, suspended solids, foam, oil sheen, and other obvious indicators of storm water pollution. No analytical tests are required to be performed on the samples. The contractor shall respond to Langley AFB for sample collection as weather and tidal conditions dictate, as defined in the VPDES permit sampling requirements (Part I, B and C). The required samples shall be collected during the earliest rain event that meets the sampling criteria. The laboratory selected by the contractor may be required to respond on holidays, weekends and/or nights. ? THE CONTRACTOR IS REQUIRED TO KEEP ABREAST OF THE LOCAL WEATHER FORECASTS/TIDAL CONDITIONS AND TO BE READY TO SEND THE LABORATORY OUT TO SAMPLE SHOULD A QUALIFYING PRECIPITATION EVENT OCCUR. ? THE CONTRACTOR MUST RESPOND TO A NO-NOTICE CALL WHENEVER SAMPLING MAY BE REQUIRED. ? THE LABORATORY MAY BE REQUIRED TO RESPOND ON HOLIDAYS, WEEKENDS AND/OR NIGHTS. ? PREPACKAGED SAMPLE COLLECTION KITS SHOULD BE IN PLACE TO FACILITATE IMMEDIATE RESPONSE. Acute toxicity testing for storm water shall be performed once annually at five outfalls, as specified in VPDES Permit Number VA0083194. Table 1a and Table 1.c provide the acute toxicity sampling schedule as required per the Base?s VPDES permit. All samples must be collected in accordance with the respective permit requirements. When storm water results exceed VPDES Permit Number VA0083194 limits or if storm water sampling cannot be conducted due to a lack of discharge at the outfalls, a maximum of 30 re-sampling events shall be allowed, the contractor will resample the outfall location and constituent(s) exceeding the permit limitation as required per VPDES Permit Number VA0083194. A maximum of 30 respective re-sampling events shall be allowed during the POP of this task. The contractor shall gather monthly precipitation data and tidal information as required per VPDES Permit VA0083194 during the January 2008 through June 2009 timeframe. The contractor shall prepare monthly reports which include the Langley AFB precipitation data and will also detail tidal conditions which prevent sample collection. The Langley AFB Weather Squadron will be responsible for submitting the monthly precipitation data in to the contractor upon request. 3.3 Contingency Storm Water Sampling/Wastewater Sampling The laboratory hired by the contractor shall perform limited contingency storm water and wastewater sampling for an amount not to exceed $5000. Sampling requirements will be submitted to the contractor in writing by the Langley TPM. Prior to initiating fieldwork, the Langley AFB TPM and the contractor will visit each sampling location. The Langley AFB TPM will show the contractor the sampling locations and discuss the monitoring requirements. Sampling will commence within 72 hours of the site visit conducted with the Langley AFB TPM. All sampling and analyses shall be conducted in compliance with all applicable Federal, State, and HRSD regulations. The contractor must respond to a no-notice call whenever sampling may be required. The contractor may be required to respond on weekends and/or nights. The contractor shall provide sampling within 72 hours from the time requested by the Air Force unless deemed as an emergency. When declared an emergency by the Air Force, the contractor will sample within 24 hours. 3.4 Annual Storm Water Report Required per VPDES Permit Number VA0083194 The contractor shall prepare the annual storm monitoring report as required by VPDES Permit Number VA0083194. The annual report shall include the pollutant-specific and biological monitoring data from specified outfalls along with a summary of any steps taken to modify either the Storm Water Pollution Prevention Plan or any Best Management Practices based on the monitoring data. This report shall be submitted to the Base TPM on or before by 15 January 2008 and 2009. 3.5 Storm Water Outfall Tidal Investigation and Technical Memorandum The contractor shall perform an investigation to examine tidal effects at industrial outfalls which require monitoring per VPDES Permit VA0083194. The contractor shall examine these outfalls at three respective low tidal conditions. The respective outfall investigations will also be conducted during ?dry conditions? meaning a precipitation event has not occurred within 72 hours prior to the outfall investigation. The contractor will attempt to perform the respective investigations at similar lunar cycle conditions to control for tidal fluxes caused by monthly variations in the tidal cycle. The contractor shall prepare a Technical Memorandum listing the recommended order the laboratory should collect storm water samples and will also include a representative picture of each outfall during low tidal conditions. The Storm Water Tidal Investigation Technical Memorandum shall be submitted to the Base TPM on or before 15 November 2008. 3.6 Unusual Conditions at Sampling Site The contractor shall immediately notify 1CES/CEV upon becoming aware of any condition (analytical or visual) during on-site collection that violates State and Federal laws, applicable HRSD regulations, or Langley AFB-specific permit limits or conditions. 4.0 CONTRACT DELIVERABLES 4.1 Status Report Status Reports will be submitted monthly to both the Base TPM and Contract Administrator. 4.2 Submittal Quantities and Payment Plan-Monitoring Plan The table at Attachment 1 contains the deliverables schedule. Attachment 2 contains the payment-monitoring plan. 4.3 Letter of Submittal The contractor shall prepare and submit a cover sheet ?Letter of Transmittal? for each submittal other than the monthly report. At a minimum, the letter shall include the following information: a. Contract and delivery order number b. SOW reference c. Date of submittal d. Brief description of item(s) being submitted e. Contractor?s point of contact Unless otherwise specified in the SOW, only a copy of the transmittal letter shall be submitted to the Contract Administrator. This transmittal letter shall be submitted to the Contract Administrator concurrently with the submittal of the associated deliverable item to the Base TPM. 4.4 Executive Summary There is no executive summary requirement for this project. 4.5 Wastewater Analytical Results Required per HRSD Permit 0011 The contractor shall be responsible for submitting analytical test results but will not be required to prepare monthly HRSD reports. 4.6 Storm Water Analytical Results and Visual Examination Reports Required per VPDES Permit Number VA0083194 The contractor shall be responsible for providing analytical test results but will not be required to submit Discharge Monitoring Reports as required per VPDES Permit VA0083194. The contractor shall prepare quarterly visual examination reports for submittal to the Langley AFB Water Program Manager. The report shall include the outfall location, the examination date and time, examination personnel, the nature of the discharge (i.e. runoff or snowmelt), visual quality of the storm water discharge (including observations of color, odor, clarity, floating solids, foam, oil sheen, and other obvious indicators of storm water pollution), and probable sources of any observed storm water. The contractor shall submit monthly reports which contain precipitation data and which detail any tidal conditions which prevent storm water sampling. 4.7 Storm Water/Wastewater Reports Not Required Per VPDES Permit Number VA0083194 The contractor shall be responsible for providing analytical test results but will not be required to submit any reports to regulatory agencies. 4.8 Annual Storm Water Report Required Per VPDES Permit Number VA0083194 The contractor shall prepare the annual storm water report for submittal to the VDEQ per the requirements listed in VPDES Permit Number VA0083194. This report shall be submitted to the Base TPM by 15 January 2008 and 2009. 4.9 Storm Water Outfall Tidal Monitoring Investigation and Technical Memorandum The contractor shall prepare a Technical Memorandum detailing the results of the industrial tidal outfall investigation. 4.10 Performance Period The performance period for this contract shall be from1 January 2008 through 30 June 2009. No sample collection may occur outside of these dates, but the contractor may complete analysis of previously collected samples and may complete monthly invoicing activities.
