- SUBJECT: NOTICE OF INTENT TO AWARD A SOLE SOURCE PROCUREMENT DESC: Under the authority of FAR 6.302-1, it is the Governments intent to award a sole source to PerkinElmer LAS Inc. for the service/maintenance on a Chromatography System. PerkinElmer LAS Inc. is the only vendor that meets all requirements for diagnost ic troubleshooting, and they have proprietary rights on the requiring activitiys chromatography system. They are the only service providers with the capability to access all repair parts and all other resources to include proprietary software to ensure t he unit is repaired immediately. This award is for a base year plus four option years. This synopsis is not considered a Request for Quotation or Proposal. No solicitation document is available and telephone requests will not be honored. No contract wi ll be awarded on the basis of offers received in response to this notice. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. If no affirmative written response is received, the ser vice will be awarded without further notice. A determination by the Government not to compete this proposed contract based on this notice is solely within the discretion of the Government. EMAIL: elayne.seiler@amedd.army.mil Please see below for Justification for other than Full and Open Competition JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity: U.S. Army Medical Research Acquisition Activity, Fort Detrick, Maryland 21702-5014. 2. Description of Action: The award will be a Firm Fixed Price contract to PerkinElmer LAS Inc. This will be a fixed price maintenance service contract for scheduled and unscheduled service which will be issued for service on a Chromatography Systems as needed. 3. Description of Services: This contract will provide support to the Armed Forces Institute of Pathology (AFIP), Biophysical Toxicology Department, providing medical and scientific investigations, to assure correct medical diagnosis in pathology and res earch services for the AFIP, DOD, Federal, State and civilian medical institutions. The Chromatography System, model ELANDRCII, serial number Z1580412 requiring these services; was purchased June 1, 2005, and received periodic proprietary software upgrade s during the warranty period available only from the original equipment manufacturer, PerkinElmer LAS Inc. The estimated total value of this contract is $142,984.68 for a one year base period of performance and four one-year option periods. 4. Authority Cited: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1). The FAR citation is FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. 5. Reason for Authority Cited: PerkinElmer LAS Inc. is the only vendor that meets all requirements for diagnostic troubleshooting, and they have proprietary rights on the requiring activitys chromatography system. They are the only service providers with the capability to access all repair parts and all other resources to include proprietary software to ensure the unit is repaired immediately. 6. Efforts to Increase Competition: Not Applicable. No effort will be made to solicit offers from as many potential sources as is practicable as there is only one source capable of performing the required services. No effective competition is anticipate d. 7. Actions to Increase Competition: There may be instances when it is not possible to compete the current acquisition. When the equipment used is replaced this may be the time where further action can be taken to increase competition. The current equip ment only allows PerkinElmer LAS Inc to diagnose and troubleshoot. 8. Market Rese arch: Medical maintenance technical personnel at AFIP confirm that only PerkinElmer technical support system and field service engineers can be used to service the chromatography equipment to support our mission requirements with minimal downtime. 9. Interested Sources: The Governments intent to procure these services on a sole source basis will be synopsized in May 2007. All responses received to challenge the award of these services on a sole source basis will be reviewed/evaluated. 10. Other Factors: N/A
