- In the interest of clarifying the SIR, one final set of Q&A is posted. No further questions will be accepted as the due date has past. Q - The response to the 2nd question refers offerors to the NISPOM, Chapter 2, et al. In Section 2-100 of Chapter 2 appears the following language: ?Contract award may be made prior to the issuance of an FCL. However, in those cases, the contractor will be processed for an FCL at the appropriate level and must meet eligibility requirements for access to classified information.? Request for Clarification: (1) Based on the language of 2-100, may an offeror in this instance that does not yet have a TS Facility Clearance submit a proposal before and in anticipation of award if the offeror otherwise meets eligibility requirements for access to classified information at the TS level, and (2) will TSA sponsor the processing of an FCL at the appropriate level after award? A - In this instance, contractors must apply with the DSS agency and while applying for the FCL must also apply for the Key perosnnel at the company to apply for the same level clearance. Since DSS is backlogged, this process could take 6 months or more and would not allow personnel from this company to be hired against the contract until it is completed. Any work stoppage caused by this process would be unacceptable to the program. Q - The response to the fifth question asks about ?audit approved? G&A rates but TSA states that certified cost and pricing data is not required. Request for Clarification: Please clarify what constitutes and will be acceptable as an ?audit approved G&A rate.? In the alternative, are firms who lack approved forward pricing rates from DCAA excluded from the competition, or may small business offerors who lack DCAA approved rates otherwise propose a competitive G&A/Material Handling Loader Percentage as part of their competitive proposal to be included in the evaluation along with evaluation of loaded rates? A - Such rate may only be substituted in the absence of an audit approved rate and the bidder must identify that it does not have an audit approved rate when proposing the substitute. Q - In view of the criticality of these additional clarifications to many small businesses in making a bid/no bid decision, and in view of the Thanksgiving Holidays just preceding the submission date, will TSA please consider extending the due date from Noon on Thursday, November 30 to 9:00 AM on Monday, December 4, 2006? A - No extension can be granted. Due to the tight turnaround period for evaluation and vetting of contractor employees through the TSA internal security process any delay in the receipt and evaluation of proposals could impact the service provided to the program office.
